The Kansas City race for the Mayor's Office in 2019 was recently upended by non-moving DUI charges against front runner Councilman Quinton Lucas and political denizens across the metro are still trying to figure out the implication.

The many cops who read this blog were quick to weigh-in on why this was a good bust.

Recently, NBC Action 41 News offered a measly street quote that attempted to explain away the situation.

Now, it's time for TKC LEGAL EAGLES to have their say . . .

TKC EXCLUSIVE LEGAL LITERATURE!!! CHECK RECENT KANSAS CASE LAW THAT TEAM QUINTON WILL USE TO ARGUE FOR A QUICK DISMISSAL!!!

It's not pretty and involved a meth'd out lady allegedly carrying a gun . . . But it protected her right to drive and will prove effective for a swift defense.

However . . .

EVEN IF/WHEN DUI CHARGES ARE DROPPED THERE'S NO DENYING COUNCIL DUDE QUINTON'S KANSAS CITY MAYORAL AMBITIONS TOOK A DEVASTATING HIT!!!

Reality check:

It's a lose/lose situation: For many voters, the dropped charges will seem like a legal trick and will continue to tarnish the otherwise squeaky clean image of the law school instructor and Council ethics reformer. And, of course taking the charge would be a bad move and smear the councilman's record with a crime.

It gets worse:

If he plays up a racial/progressive angle against the Lawrence, PD -- Who constantly get pushback over their sometimes sketchy DUI crackdown tactics -- he loses so many middle-class voters who admire one of the most affable, approachable and well-educated council members.

Public perception is everything . . .

This crisis revealed a council dude retreating into legal tactics that tend to anger most pleb voters.

Takeaway . . .

Moreover, the councilman arguing that "he did the right thing" doesn't resonate with voters or potential donors and so far his supporters are scrambling unsuccessfully to manage the scandal. The candidate who once held the esteem of elite local power players has been tarnished over a drunk charge that contradicts his credentials as an intellectual and community-minded leader.

And while Kansas City could argue the merits of the case for Councilman Lucas as a more down-to-earth mayoral candidate following this embarrassing bust, this town typically shies away from contentious topics and is much more likely to politely ignore the politico and look for other options in a crowded field.

  3. When I first saw the news, I thought he was done. Can't drink and drive. Turns out, he wasn't drinking & driving. He was sitting in his car for almost an hour which both him & the police narrative agree on. Quinton will get through this because Quinton did not do anything. The "rules are rules" people would argue for successful jaywalking busts so who cares what they think.

  8. Not sure how Kansas law is but in Missouri it use to be all you needed was to have your keys in the ignition to get a DUI even if the car wasn't moved. With that said, the law isn't applied equally at times. If you recall, KCPD had a Chiefs player sleeping drunk in his car on Linwood and they just let him go back to his girlfriends apartment. He killed his self later that day at the Stadium.

  11. TKC, thank you for at least trying to provide some balance here, of course the charges against Councilman Lucas should be dropped because he did not move his car!

    What I think is worse is the rush to judgement from your readers and now they are acting troll-like in looking to convict an innocent man before he is found guilty. Don't you people have any shame? We need to let people have a fair trial before they are thrown to the wolfs. TKC you really should have waited to cover this story until the case was decided and then weighed in with the arguments and the legal tactics. That would have been far more equitable.

    However, I think we need to give Jolie Justus a better look and more fair treatment now. Once again she is the front runner and has the best record to lead our city into the future. Quinton has squabbled with our Mayor Sly James too frequently and has been a roadblock to progress in many ways.

    But Jolie Justus has been a leader in the push to keep our momentum going and make Kansas City best. She helped to get the new airport started and worked valiantly against crime.

    Jolie is the new leader in this race for good reason. While I believe that Council member Lucas deserves fairness, he should think about endorsing Jolie Justus as we all get on the same team to continue to make KC a world-class city.

  14. If the charges are dropped I would see it as a political pressured event. How many others have been charged with this exact charge and didn't get a free pass.

    See that's what is so wrong with this world today in that too many think our laws only apply to certain people based on who they are. 99% of those who read this site wouldn't ever get this charge dismissed. The law is very clear and the writing of such is very clear on how you can be charged with a DUI.

    Councilman Lucas was caught and charged as he should have been the same as anyone else should have been, But he thinks due to who he is that special circumstances apply. That's complete hogwash and I think even less of the man now because he is incapable of admitting his mistakes. Remember it wasn't all that long ago that another Kansas City Councilperson thought they were above the law as well.

    The case needs to continue on with no special treatment being allowed. Maybe some judges and prosecutors in Lawrence need to be voted out of office as well.

  24. Politics aside, do we really think that a citizen (issues of race aside) who is merely sitting in his lawfully-parked car is ANY business of the police? How twisted is that to even consider whether it could be a crime?

    FYI: No one advocates actual impaired driving, but...Check out the stats on Alcohol Related Traffic Deaths and you will find that the decrease in such deaths since the "legal limit" was dropped from .15% to .08% is virtually the same as the decrease for ALL traffic deaths. Seat belts and air bags and vehicle innovations have done far more for safety than MADD and the politicians it supports.

    3. Uh, Phil, did you consider that the officer was a good guy doing his sworn duties in service of public safety AND MAKING IT HIS BUSINESS TO CHECK ON ANY DAMN BODY IN ANY FRIKKEN SITUATION BECAUSE SAID OFFICER DEEMS IT NECESSARY TO DO SO?

      Suppose that popo watched for a few minutes after running a tag/NICS inquiry on Lucas' car and this officer saw that with his patrol car bright headlights beamed into Lucas' car with engine running, Quinton was seen TOTALLY IMMOBILE BODILY, just stiffly sitting, slumped forward or reclined partially out of view--WHICH WOULD PRESENT POSSIBILITIES OF A DRUGGED, DRUNK, INJURED, OR DEAD OCCUPANT!!

      And, MADD has done great with public education about the hazards of impaired driving. The air-bags and other crash safety "equipment" in vehicles is only part of the equation for surviving wrecks. How about giving thanks to the emergency medical professionals--from first responders at scene, to the ER staff, and to the rehabilitation therapists for increased survival rates?!

      Not just the fear of injury, death, jail, lost employment, raised insurance rates, but HUGE ATTORNEY FEES should and does DETER decent people from DISTRACTED DRIVING OF ANY KIND!

  26. That is unfair and you know it! The streetcar is one of the best things that ever happened to Kansas City and the benefits have allowed us to achieve amazing and unprecedented growth. In fact, the streetcar saves a lot of people from DUI charges because of its convenience to all the most lively entertainment hot spots in town. While I respect Councilman Lucas, I think that when we look at the best candidate to keep out momentum, obviously it's Jolie Justus. She has done so much for this city and if you don't realize it then you are letting yourself be misinformed by this blog and all the haters who read it.

  31. In regards to Lucas arguing he "did the right thing" by not driving home, yes that was a good decision, but the public expects their public servants to never put themselves in a situation like that in the first place.

    According to Lucas' own statement to police and media, he consumed 2 beers at the initial function, had someone else drive to the after-party event, where he then possibly consumed an additional one-half beer. Really?

    Lucas was drunk and unfit to operate a motor vehicle after 2-2.5 beers? Constituents may be disappointed Quinton is such a lightweight!

  39. The crime is popularly referred to as "driving" under or while, but that's really a misnomer. The statute refers to operating or attempting to operate, not driving. Engine running? That's operating the vehicle, although not driving it. Key in ignition with engine off? Who knows, but arguably it's attempting to operate.

    It's a matter of opinion whether police should investigate a person asleep (or maybe passed out drunk) in the driver's seat of a car. Certainly the officer would catch heck if he let it go, then the guy woke up, drove drunk and killed or hurt somebody. Better practice probably to investigate.
