Deets:
Lucas, 34, of Kansas City, was booked into the Douglas County Jail early Friday morning near Eighth and New Hampshire streets, jail records state.
He was released on bond and ordered to appear in municipal court in November on the misdemeanor charge.

Reached Friday morning, Lucas said he had been drinking and decided he shouldn’t drive back to Kansas City. But, he said, he never moved his vehicle from the public spot it was parked in. He said he “dozed off” in his car.
“I took the choice to behave responsibly yesterday,” Lucas said. “I did not drive or operate a vehicle. It was in a parking spot; it did not move from a parking spot.”
Lucas said that while he respected the work of the Lawrence Police Department and the arresting officer, he plans to contest the DUI charge.
“I look forward to having the opportunity to explain the situation in court,” Lucas said.
Little known fact, TKC readers tell us: If you have your keys in the car to keep warm, even if you're parked, police can bust you for DUI.

Dear Friends,
Last night there was an incident in which I made the responsible choice not to drink and drive.
Last evening, I attended a university event and a post event gathering. I consumed alcohol. At 10:45pm, I decided to leave. When I got to my car I decided that I was not prepared to safely drive home to Kansas City. I decided to behave responsibly and wait in my car until it was safe to drive. Apparently, while waiting, I dozed off. I never moved or attempted to drive my car.
The car was legally parked in a metered parking spot. I never moved my car, never shifted a gear, never released my parking break, and never attempted to move the car in any manner.
After I had drinks last evening, I chose not to drive.
Around 11:30pm, a policeman approached my car and apparently found my behavior suspicious. Here is what I do know, I have the utmost respect for the men and women of the Lawrence Police Department and the policeman involved. He was courteous throughout, as was I. What I also know is that in making the critical decision not to drive last evening, I behaved responsibly.
I look forward to resolving this issue and explaining the responsible choice I made not to drive under the influence.

Sleeping in a parked car, in a legal parking space, drunk or not, isn't or shouldn't be legal grounds for a ticket. What I didn't read in his statement is whether the car was running or not. I believe a running car changes the legality of it.

ReplyDeleteAt this point Quentin Lucas needs to think about resigning and dropping out of public life altogether. Obviously he has some kind of problem where he can't even make it home to his destination without having to take a nap. I think he's got issues that he needs to deal with, right now in Kansas City we are at a crucial point in our history we can either keep up our momentum and move forward with the progress we have made under mayor James or we can delve into the same kind of radical politics that holds the rest of the nation back. Quinton Lucas should take care of himself first before he tries to meddle in the Affairs of the community. I don't wish him any thing but the best but I think it would be for the benefit of us all if you dropped out of the mayoral election.

Quinton's defense is spurious at best and seems like nothing but his attempt to engage is a conniving form of legalese. He not only admits to being drunk but also tries to fool the public by using very meticulously thought out language and saying: "He did not engage the ignition."

Quinton endangered lives, he put himself at risk and his actions inform us that he's the kind of guy who gets so drunk that he needs to sleep it off in his car.
For his sake I hope he is more honest with himself than he is with the rest of the public.
He obviously needs some help.
But he shouldn't do so while the mayor of Kansas City.
That is too much to ask from voters.

Evidence that a person is in the driver's seat of a car with the engine running is sufficient circumstantial evidence of an attempt to operate a motor vehicle to support a conviction of DUI. State v. Darrow, 374 P.2d 673. Movement of the car is not necessary.

The law is the law. Many people have been convicted of a DUI for just sitting in their vehicle. Lucas is a likable guy but I consider his work in the City Council to disqualify him from being a Mayor. His judgement in Lawrence also makes hurts him significantly.
ReplyDeleteI liked Lucas until I saw his speech in front of 18th and Vine where he stated that the City's investment in the Jazz District was a key to the City's economic resurgence.
ReplyDeleteIn reality the only folks who will benefit from this investment are the contractors and developers who will receive contracts for this work along with the folks who will be hired to maintain this district.
The Council highjacks city funds for this district and creates an economy which will benefit only a few.
Maybe he was on City business to discuss how we might be able to promote the Jazz museum. Are his expense accounts available? 55 cents a mile and the bar bill?
