Fallout from a Kansas City mayoral game changer continues . . .

Following the bust of councilman Quinton Lucas for suspected DUI . . . The political predictions and arguments continue to circulate . . .

Here's one talking point that deserves to be debunked . . .

Councilman Quinton Lucas claims that not moving his car absolves him of DUI charges. FALSE.

FACT: People get convicted for DUI for doing nothing but sitting in a car ALL THE TIME.

Reality . . . Lawrence, Ks. is a college town and police have a great deal of leeway when it comes to busting the wide array of drunks on their streets.

Initially, we thought the "key in the ignition" rule applied . . . But the DUI regs can be actually much more strict. A few Kansas police have sent word our way noting that any DUI suspect driver in a car with even "access" to their keys can be arrested for DUI. Is it fair? NO but nobody said DUI laws are fair, blame MADD . . .

Here's a quick quote that might help further our understanding via a simple internet search that no other newsie in KCMO has bothered to conduct . . .

In Kansas, a motorist can get a DUI even without actually driving: The statute defines DUI as “operating or attempting to operate” a vehicle while under the influence or with a prohibited BAC. Kansas courts have said this includes any “overt act to engage” and does not require movement of the vehicle. So while driving is sufficient for a conviction, it isn’t required.

Of course, this is a first suspected offense for Mr. Lucas so it's likely courts will give him the benefit of the doubt and odds are he can get the charge thrown out. But the fact remains, a lot of people have been convicted for DUI under the exact same circumstances Mr. Lucas describes.

More importantly . . .

    1. Don't know why more local media didn't focus of the claim from Lucas. Not moving the car is a really weak defense and has NEVER stood up. What surprises me is that Quinton is a law professor. He should know this stuff. I know he's not a traffic lawyer but this is 101.

  2. The laws are messed up. DUI....DRIViNG under the influence. If you don’t have the keys in the ignition....I mean cmon.

    The thing about this case is even if Lucas slept and woke up at say 6 or 7am and drove home his BAC was most likely still over the legal limit. People get DUIs all the time the following morning after a night of drinking.

    I’m not trying to rain on Lucas because I’ve had a dui myself and know others who have as well, but KCMO really needs to get rid of democrats for a while. The tax and spend going on in this city is ridiculous. So much money going to waste. Crime and cuts to police...it’s just not working.

    What should be alarming to everyone is how low the voter turnout in KCMO is. Residents can complain but they really should be complaining about the paltry voter participation.

  26. The brotha went to Cornell law that’s pretty good actually. He seems like he is very smart, but his campaign website doesn’t dig into much specifics. There is no real meat on what he would do or specifics on what needs to be done in KC. Very light brush strokes.


    He does have a photo gallery of himself though. One of which he is with Sharice Davids. Why is Sharice hanging out so much in public in KCMO? She seems to be popular with the progressive left of the city. She should have started there and worked her way up instead of trying to go straight to dc. Yoder for the win, and I think Lucas still has a good shot at winning.

  32. I walked into a bank wearing a ski mask, and I had a pistol in my pocket, but I never engaged the pistol. I never pulled the pistol out of my pocket and pointed it at anyone. Also this IS in Lawrence and they read rules a little more liberally than other places, he could get off. Maybe he should check with Paul Davis and see how to get around the law in Lawrence.
