Mayor James pushes open carry ban for Kansas City
At Mayor Sly James’ urging, the Kansas City Council’s public safety committee on Wednesday endorsed a measure that would ban people from openly carrying firearms in the city limits.
Mayor Sly sponsored the ordinance and Lynn focuses on a current gun debate in the house . . . However . . . Open Carry has been the standard in Missouri for law abiding gun owners for quite some time, this isn't new law . . . This is Mayor Sly taking away gun rights and GOING AGAINST MISSOURI 2ND AMENDMENT PROTECTION.
An AWESOME KC INSIDER told us the real deal on this topic this week:
"What this says to me is that not only does Sly not know the law, the City legal department is too afraid to tell him. His subordinates are too afraid of him to warn him that this effort subverts State Law and won't stand up in the court of law. All he's doing here is showing that he doesn't know about the rules and regulations that govern our State and nobody is willing to correct Mayor Sly James."
Again, this issue is more akin to Open Carry struggles in suburban Kansas where, after an expensive legal battle, Open Carry advocates won out.

ReplyDeletePretty sure municipalities and states can still pass ordinances/laws that regulate how firearms are carried. I don't think the 2nd Amendment is implicated - at least not as the SCOTUS interprets it. So unless Missouri wants to make these sorts of bans illegal - cities can ban open carry.

ReplyDeleteMy advice is for the people who sue on this to seek punitive damages as well. It's time to teach the Mayor that he can't take away our freedoms.
Simple: Open carry is law in Missouri. If KC tries to make their own law the state law trumps any municipal statute and will be accordingly struck down.

ReplyDeleteActually James Madison who wrote the 2nd Amendment never mentioned you idiots having guns in the first place. It wasn't until the late 70's when the NRA moved to Denver the idea of gun ownership was a 2nd Amendment Right.

ReplyDeleteThis is right on the money. There's a host of things the Mayor doesn't know about the law. That should send the message that he is and will continue to operate outside of the law. Somewhere, Sly got it in his head that local government is powerful. It's not. Nothing the city does can trump State law. Nothing. If state law permits what local government does not, the state law will control. All the ivy-league education in the world just does the average Negro no good. Ambulance chasing is much different than real law issues. This mayor is totally out of his league. And yes, the City's legal department is afraid, very afraid of something. They won't even admit when they've broken the law, which is an ethical violation and cause for disbarment.
Let's just cut to the chase, we need to get rid of the second admendment all together. Let the cold dead hands secernio begin.
