ReplyDeleteWith more business being conducted remotely all a company has to do is open a tiny office outside of KCMO and declare that all their home based workers are working from that office. They might also route their revenue through these offices cutting off most of the KC profits tax and licensing tax on their business.

ReplyDeleteIt's not a loophole. Q wants to tax employees of KCMO employers who work from their homes outside KCMO and never set foot in KCMO. The justification for the e-tax was that those employees drive on KC streets and use KC services when they work in KC, therefore they should contribute to KC upkeep. That rationale no longer works when the employees do not drive on KC streets or use KC services. There has to be a nexus between the taxing jurisdiction and the taxed person. There would be none if Q fixes the "loophole." The fix would not pass constitutional muster.
