TKC TOLD YOU SO!!! KANSAS CITY MAYOR QUINTON LUCAS WORKING TO DENY 2020 EARNINGS TAX REFUNDS!!!

Back in August our blog community warned readers that there was a plan underway to thwart earning tax refunds.

It's a sketchy tech gambit but now it's news fact.

Accordingly, here's the perspective from Mayor Q on the revenue source that's the only thing keeping Kansas City out of bankruptcy.

Check a recent quote from a glorified blog on a story our blog community broke months ago . . .

"Mayor Quinton Lucas said he believes the city can legally keep earnings taxes from suburban workers who earned wages outside the city limits in 2020.

“I’m clearly in the camp that I don’t think Kansas City should … refund it.” Lucas said he’s working to round up support for an ordinance or resolution that would empower the city to keep the money.

You must really hate Kansas City. Without that money then KC would go bankrupt and that would have a huge ripple effect across the entire metro. Sad that you would rather destroy the entire regional economy than just pay what you owe.

It's like the Democratic election officials and judges -- if the existing rules don't allow you to win, change the rules in the middle of the game. Screw doing what's right and fair. KCMO companies need to seriously consider moving outside the city if they pull this kind of crap.

I think the city will win in court. The only way that these employees would not have to pay is if the companies they work for moved away from Kansas City MO. Whether they have been physically working at home does not change the fact that their salaries and wages are from KCMO sources. Don't try to cheat white folks.

Another reason to avoid anything related to Kansas City. Don't work there, don't work for companies there and damn sure never spend any of your money there. Leave the city and let the rest who thinks it's so great drown in the shit.

In 2019, they gave refunds for days not worked in KCMO. In 2020, they give the finger and a tax bill for days not worked in KCMO.

Obviously Quinton's spirit animal is Wile E. Coyote. This is the move of a super genius with the e tax coming up for renewal and people facing much harder times than the city of Kansas City is.

Screw the people that actually earned it outside of the city! Kansas City can better spend the money that they earned outside of city limits than they ever could! Just look at the glistening examples of how wisely KC acts as stewards of other people's money LOL!

Crime is out of control.

Infrastructure is crumbling.

Downtown is dead.

The Plaza is dead.

Street murals rock.

Developers are pulling out of sweetheart deals the council made with them.

Businesses are closing down permanently.

People are taking jobs outside of the city limits.

Residents are moving outside of city limits because the city is dysfunctional.

Citizens are seeing what that new airport that was never going to cost them anything unless they used it is actually starting to cost them.

The zoo is getting a brand new megamillion dollar aquarium.

And best of all the toy train that no one rides is getting expanded.

New Hampshire has sued Massachusetts on behalf of their residents' being charged Mass. income tax while working remotely in New Hampshire. The outcome of that case will determine the outcome here, but it will take a while, so relax.

From the KC etax ordinance:

The etax is imposed on: "All earnings of nonresident individuals for services performed or rendered in the city."

Definition: "Day worked in the city means any day or the portion thereof in which the taxpayer renders or performs services in the city."

Allocation to nonresidents: "The earnings subject to tax of any nonresident individual in any case in which the work is done or the services performed or rendered both within and outside the city shall be ascertained as follows:

(1)Working days. If the amount of such earnings depends primarily upon the amount of time devoted by such individual, then the portion of such earnings subject to tax shall be that portion of such earnings which the total number of days worked within the city bears to the total number of days worked within and outside the city."

The city is going to lose the class action lawsuit that will be filed if it tries to tax people who were working from their homes outside KCMO in 2020.

Unfortunately, the average person seeking a refund is probably only talking about $500. The City whether legally or not will not refund this money in hopes that you just go away. If you did try and sue, no lawyer will take the case so you will probably have to file a small claims action. The City will fight you with their legal department, and even if you prevail, the amount of time you devoted to it would not be worth saving $500.

With that said, maybe one of you readers/commenters is an attorney willing to file a class action lawsuit. The law is pretty clear, you must live or work in KC to pay earnings tax. Let the city prove you worked remotely in KC just because the company or server is located within the city limits.
