Continued Kansas City coronavirus precautions, mandates and social distancing orders have created unintended consequences and a devastating threat to this cowtown's biggest source of revenue: The Earnings Tax.

To wit . . .

INSIDERS FEAR MASSIVE PUSH BACK FROM TELEWORKERS AGAINST THE E-TAX!!! ACCORDINGLY, CITY HALL IS NOW DEVELOPING E-TAX GUIDES/THREATS/WARNINGS TO EXPLAIN/ARGUE THAT PAYMENT IS STILL REQUIRED IF EMPLOYERS ARE BASED IN KANSAS CITY!!!

Behind the scenes Kansas City is taking guidance from STL given that "the Lou" has already announced plans to deny refunds to remote workers.

Noncity residents working remotely because of the pandemic are not eligible for refunds, said Tom Vollmer, an STL deputy collector for the city’s revenue department.

“They are still working from home, accessing a city-based business,” Vollmer said. “They are accessing the databases and using their computers and stuff from home.”

Of course, the KCMO is going to start with a polite but firm series of letters to local businesses encouraging them to smack down workers who gripe about paying the E-tax.

Translation . . .

THAT'S RIGHT, KANSAS CITY STILL WANTS E-TAX EVEN IF WORKERS NEVER SET FOOT IN THIS COWTOWN!!!

Previously, tax fighters had hoped that telework would provide an e-tax loophole but the brilliant legal minds at City Hall are now ready to challenge that assertion when telework is connected and facilitated by a company within city limits. And so those pointless Zoom meetings might cost many locals dearly.

Of course, this will INEVITABLY become a legal debate . . . Don't trust TKC with tax advice because we are NOT giving any . . . This post merely offers the FIRST preview of a fight that teleworkers will be forced to undertake with employers, accountants and City Hall.

  5. NY City started this and now other cities are following. Look for court challenges. The fact that a computer server is in a city doesn't give a city the right to tax non residents.

    This probably has more to do with Cerner and Burns & Mac not getting their TIF funds if their employees work from the suburbs.

  9. This is interesting when companies based in Kansas City but have locations out of state those workers don't pay the e-tax. This e tax applies to those living and working within the city limits.

  13. If employees are working from home on an indefinite basis employers should stop withholding the E tax. Let the city go after thousands of employee's to try and collect. The city may refuse to refund taxes in violation of the law but they will have trouble getting courts to side with them if they have to sue to collect.

  14. I would hope the employers getting TIFs for their E-tax collections are careful about withholding. If they withhold in violation of the law and then employees are forced to spend legal fees to get refunds I could see class action lawsuits.

  15. KC and St Louis are allowed the E-tax by the state of MO. Look for the legislature to get involved if they screw over too many suburban taxpayers.

    That will take away 50% of KCMO's land area,
    42% of its population, and (according to City Hall's own statistics),
    63% of its REVENUES, not counting anything received from the Airport!

    The howls from 12th & Oak will reach Heaven, but after the 1980 Constitutional changes and prior Court decisions, the Law is on the northlander's side.

    The priorities are street graffiti, finding somebody on the toy choo choo and graft from the new KCI that we didn't need before the zombie virus cootie crap.

  19. This is contrary to how this tax has been applied in the past. What determined whether or not you paid it was where you sat your butt while working. Days that you travelled or worked in other locations the e-tax was not assessed. To claim that the location of the home office now determines if you pay the tax, even if you do not work in the home office is huge reach and the city ought to be sued by the employees who are getting screwed.

  28. The E-Tax applies, i.e. to "All earnings of nonresident individuals for services performed or rendered in the city." It's going to be a tough question whether a person working from home in Independence for an employer located in Kansas City owes the E-Tax. The City will argue that the employee's services are performed in Kansas City because the services are not complete until the employer receives them. Employees will argue that the services are brainpower and entering information into a home computer, both of which are done outside the city.

    It's a tossup which argument will prevail in court.

The voters in this fucked up shitty are stupid, and always uninformed. I talk to my neighbors about national politics and get blank stares as they think about their McDonald's upcoming trip.   30. The e-tax started out as a promise to KCMO residents that there would be FREE trash bags and pick-up.
    So its very beginnings were based on a lie.
    Then it was sold to folks who worked in KCMO, but didn't live there, that the tax supported all the "services" that were provided to them.
    Which are mostly non-existent or at least certainly difficult to identify.
    So actually the e-tax is just another method of filling the huge slush fund that is generously referred to as the "city general fund" and is regularly tapped for funding pretty much any proposal that comes along and can get seven votes.
    Not at all clear that a legal challenge wouldn't prevail.

  31. The first 1/2 per cent was passed in 1964 for additional police funds, the other 1/2 per cent was passed in 1973 for free trash pickup, free trash bags and no burning of leaves and trash.

  33. The city law department has begin filing lawsuits against individuals dating back to 2014 that they believe were residents of KC based on IRS information. They are taking $100 tax assessments and turning them into collections for $1000 for interest, penalties and legal fees. Some of these people didn't live in KC or work in KC but now they have to fight the city to prove otherwise.

    The Democratic leadership (Schumer/Pelosi) is deliberately trying to hurt the people in hopes that they will blame Trump. They are also demanding bailouts for the Blue States to cover their own pensions which were broke before this virus. This is putting government employees above the people. As reported before, they have promised the Blue State governors that if they keep the lockdowns and hurt the people enough to vote against Trump, they will bail out all the state employee pension funds which are broke. Indeed, the 2020 elections will be a monumental turning point in the United States if the Democrats win. We have politics becoming so toxic on both ends it is insane.
