Missouri Gov. Mike Parson says pardon likely if St. Louis couple charged
Democratic Circuit Attorney Kim Gardner is investigating Mark and Patricia McCloskey, both in their 60s, for an incident on June 28. Protesters who were marching to the nearby home of Mayor Lyda Krewson walked onto the private street where the McCloskeys live.
Smart move by the Gov.

People can still sue you in civil court for waving guns at them. You cant use guns to protect any property in missouri. Only your life. Those gun wavers broke several laws.

The Feds are hot on the Trail of the Governor, the Speaker of the State House. and it's becoming clear blood is in the water there and These jerks are in huge trouble. If there was a small child in the group it could be a even more serious offense. Some of those people are just trespassing. Some may have thought the gates were open and so they were not trespassing. Anyway you cant shoot a trespasser in Missouri or Kansas. Thats only in movies
ReplyDeleteDavid Jungerman, a Kansas City business owner shot a burglar at night, in own his business, didnt even kill the guy, just an on purpose leg shot - he was sued and lost millions of dollars, his business and home. It was a civil suit. (David was so mad he shot the attorney dead). David didnt understand you cant use deadly force to protect property in Missouri. Case precedence is set.

ReplyDeleteComplete and utter ignorance. Read Missouri's revised statutes referencing the Castle Doctrine. Deadly force may be employed to protect one's life AND property in which one resides or currently occupies, with no duty to retreat.
The couple were morons, and a little reading-up on their background indicates they are also assholes, but they didn't break the law by brandishing firearms in protection of their life and/or property.

You can tell the homeowners were unexpectedly reacting to the angry mob of a hundred protestors as the couple are barefoot; relaxing in their home until their property was invaded.
If you don't own property; you cannot appreciate the years of sweat equity and hard work that goes into buying a home and as a result homeowners are going to protect their homes and family no matter what.
The St Louis couple obviously did the right thing as their home and neighborhood were not vandalized and destroyed.

The "David Jungerman" is set in stone court case law, it sets all precident in Missouri. Had the couple shot a protester, that verdict case law against Jungerman would have been applied to them. A protester loses a leg due to a bullet they shot - the couple will pay millions in damages as Jungerman did. I dont like it, but you need to be aware of that. Juries HATE shootings that only protect property, especially if that property (house) is already covered by insurance). Thats what insurance is for. Now if the protesters were armed and attacking, its a different story. Missouri law always leans toward protecting the criminal. Thats why I carry an expensive firearm insurance policy for CCW holders. It would pay my bail, $500,000 in attorney fees, and other costs if I was charged during a lawful shooting. Right is considered wrong in the courts. You need to be aware of that. Its easier for a criminal to get off charges, than an innocent person. Jurys like to send messages by handing down sentences to seemingly innocent people. Read the Jungerman case.

That couple has many lawsuits. He sued his siblings, his Dad's caretaker and Dad. He sued to get ownership of their mansion from the Busch beer family. READ ABOUT THAT! Its too bad the news doesnt show the entire picture of their house. Its huge, like the house at 55th and Ward Parkway. Yes, the house here that looks like a giant library. Their house is that large. You would need a ring of at least 24 security guards (6 on each side) to guard a property that large. Google a pic of their house. Its massive. Who was guarding the back?

Here is a simple fix. Don't bring charges until after the November election when Biden wins. The statute of limitations gives you a few years for Parson and Barr to be gone.
