Charges Filed Against McCloskeys, St. Louis Couple Who Pointed Guns Toward Protesters

Updated at 6:55 p.m. July 20, with the Missouri attorney general filing a request for the court to dismiss the charges and comments from state Rep. Rasheen Aldridge, D-St. Louis St. Louis Circuit Attorney Kim Gardner has filed charges against a St. Louis couple who confronted protesters with guns in June.

  9. When the rioters broke down the gate entered onto private property didn't leave when told to, the property owners had every right to point their weapons.

    Kimberly Gardner is under investigation anyway and she was caught using campaign money for her private residence. She had to pay a lot of money when she was found guilty. She is funded by George Soros and he tells her what to do. She's his prostitute. She has made a lot of people mad in SL including judges. The only problem is these people are democrats and have given large amounts of money to the democratic party. Maybe now they can see what a mistake that was.

  17. You have to use equal force when defending yourself. If no protesters were armed, you can't point guns at them, as no gun threat exists. But you could wear the rifle slung across your chest, as that's always allowed on your own land. That would have worked. But unless threatened by deadly force, brandishing a gun is too much.

    1. Greg, not so. If you are in fear of your life, and being outnumbered 350 to two or whatever the number was would justify that, you can defend yourself with a gun. If someone pulls a knife on you and you are in fear of your life, you can shoot them.

    Shortly after Gardner's charges were announced, Attorney General Eric Schmitt's office filed an amicus brief urging the court to dismiss the case against the McCloskeys. John Sauer, Missouri's solicitor general, wrote that Missouri's laws "specifically authorize Missouri citizens to use firearms to deter assailants and protect themselves, their families, and homes from threatening or violent intruders."

  20. Even with a gun, one hundred to one is not commensurate force. He only had a thirty round magazine in the rifle and could easily have been overwhelmed and killed, despite taking some of the cowards in the angry mob with him. The idea that a citizen protecting his home is not allowed to pull a gun until he sees a gun is completely fallacious. All he has to show is that he had a reasonable fear for his life, even without the Castle Doctrine. Being confronted by a large group of angry people is enough to establish that.
