The saga continues and the war of words ramps up.

Jackson County Executive’s Response to Legislature

KANSAS CITY, Mo. – Jackson County Executive Frank White, Jr. has issued the following statement in response to a request regarding the 2019 reassessment process by the Jackson County Legislature:

“Today I received notice from my staff, who learned through the media, that a letter was being sent to me from members of the Jackson County Legislature. A letter I have still yet to receive from the Legislature.

In that letter, members of the Jackson County Legislature requested that I discard all of the 2019 assessment values and freeze those values at last year’s level.

I will absolutely not do so.

Their request is illegal and would cause many to pay more than their fair share of taxes because those whose property is properly assessed would continue to be responsible for their taxes, and would have to pay for those whose property is undervalued.

How is that equitable? How is that fair? How does that help our schools, libraries and mental health services?

While I expect this type of cheap political stunt from some on the Legislature, I must admit that I am surprised and saddened by some legislators’ participation. The County Assessor, County Associates and citizens deserve much more from each of them.

We know that the real estate market has improved. We know Jackson County has undervalued many properties for decades. The legislature knows this too, in fact, it’s in their letter. Legislative member Crystal Williams stated it during Monday’s legislative meeting:

“We’ve also been undervalued in Jackson County because of a lack of political will to address these issues for what appears to be decades. That’s understandable.”

Now she and her colleagues are doing the exact same thing.

It’s that lack of political will that keeps the County from moving forward and I will not kick the can down the road again. I will not break the law because they are afraid to do what’s right. I will be politically courageous enough to stand up and do the right thing, even when it’s not popular.

Furthermore, I understand taxpayers are confused, scared and in some cases, angry that they are now being assessed at fair market value. They have every right to voice their concerns, to have their questions answered, and most importantly, to a fair and accurate assessment. Our assessment department has been and continues to work with everyone to ensure that happens. Legislative member Ron Finley acknowledged that during Monday’s legislative meeting:

“I don’t see yet that there’s some big conspiracy going on to run everybody off the west side. I know you have that impression, but you’ve heard the assessor saying they’ve gotten complaints. They’re looking at what they can do.”

This Legislature is failing to give the assessor adequate time to do her job. And anyone who tries to blame Jackson County Assessor Gail McCann Beatty for this situation is both uninformed and quite simply wrong. She is doing her job ethically and fairly and I will continue to support her.

Lastly, state statute says the assessor must deliver certified values to the County Clerk on or before July 1. As such, the assessor will fulfill her responsibility.

If the Legislature directs the County Clerk to break the law and not send those certified values to taxing authorities, that’s up to them. The County Clerk does not report to me, she reports to the Legislature.”

  15. This is the same Frank White that said the Legislators didn't have the legal authority to move Combat under the prosecutor. He filed suit, county spent hundreds of thousands on legal fees, and the judge ruled against Frank. And the same Frank White who fired a county employee who wouldn't break the law when Frank wanted to illegally spend some Combat money. That suit will probably cost the county millions.

  17. ^^^ 8:17 What isn't getting enough attention in all this is the woman Frank appointed to collect these property taxes in December is a completely unethical lawyer. She was implicated in falsifying an inmate's death report when she worked in the county counselor office. She's also named in that ex employee's lawsuit.

    I will be burning my tax bill when I receive it in December. I'm not paying another dime to Jackson County with Frank White running this clown show of crooks and incompetents.

    I am under the belief that both should go. If Frank wants to sink with the ship, let him. He is lined up with John Modest Miles, that wretched old lady that they claim was the first whatever, Gail Beatty and possibly now Ron Finnley, who I thought was an independent voice of the people. Everybody wants to be liked, I supposed.

    First, Gail didn’t do her job! She fucking failed miserably, lied about doing work she didn’t, didn’t subscribe to the MLS for a minimal $2K - (they spend more on that on lunch dates and car allowances.) She was supposed to have a report turned into the State/County in May. It’s the end of June - and the only reason she did it on June 26th is because she saw it on the news. Are you telling me this former State Rep doesn’t know the laws about assessments. She fucking sucks at appraising property - She submitted all of those bogus appraisal to the City for the East Patrol Project together with her that bird-brain Beverly Easterwood.

    It’s time she be brought up on ethics violations. Have the FBI look into the involvement of the City’s East Patrol project (since it was a federally funded endeavor).

    She has earned the wrath that is before her and she, without a doubt, should be fired. If that means Frank White leaves too... Buh-bye.

  24. Can someone tell us who to contact to join the class action lawsuit? I know one was filed but I can't find any info on how to be included.

    I filed an informal appeal but don't know if anything will be done about it.Will we be notified if our informal appeal is denied or accepted? It costs money to hire a lawyer for a formal appeal before the BOE and I hate to spend it if I don't have to.

  36. To residential property owners: if you sold your house, would you be satisfied with the old assessment value as the sale price, or would you demand an amount closer to the new assessed value?

    1. Market value and assessed value are two different things. ASSESSED VALUE IS NOT INTENDED TO BE MARKET VALUE. ITS A VALUE ASSIGNED FOR THE SOLE PURPOSE OF ASSESSING TAX LIABILITY. The two were never intended to be the same.

  40. If you show up to a BOE appeal without a lawyer you will get no results. Only the people who come with lawyers get a reduction. These lawyers all are in bed with the members of the Board hearing your case, they all play footsie together. Individuals representing themselves get screwed. I have been though this once before, 10 years ago when Jackson County tried to increase the value of my commercial property.8 times. After paying a lawyer to go to the BOE the value only went up 4 times. it has held fairly reasonable for the last 8 years and is doubling this tax cycle.

  42. 10:06: you are right. Missouri law expresses the two as "assessed value" and "true value." (The latter is market value.) "Assessed value" is defined:

    "The assessed value is the portion of the true value in money on which taxes are based. In Missouri, the assessed value of property may not exceed 33.3 percent of its true value in money. For real property, residential property is assessed at 19 percent of its true value in money...." (Section 137.115.5)

    The Jackson County Assessor's Office ties assessment value to market value but does not give any details: "The result of this process is to set the market value, and thus, the assessed valuation of property in Jackson County."

    This possible discrepancy at least raises the suspicion that JCo based its recent assessments on "true value" rather than on a percentage of true value.
