"The County had asked that the entire lawsuit be dismissed, and the judge denied that. Cass County Judge Jacqueline Annette Cook, the same judge for the STC trial last year, proceeded to ask both the County attorneys and the attorneys for Humphrey, Farrington & McClain in Independence about the timing and mechanics of notifying persons in the suit, if she were to certify the lawsuit as a class action. (Although she said later that she had not made up her mind on this issue.)
"Let me clearly state what is at risk here: In open court yesterday, the County clearly stated that it has not followed the 2024 STC order to roll back any of the 2023/24 assessments. The County told the judge that the only relief for the 200,000 taxpayers was to go through the appeal process, one by one. Cook, asked, incredulously, whether those deadlines for appealing had already expired, hadn’t they. The County attorney agreed."
