"Gov. Kelly claimed the AG’s office declined to take legal action against moves by the Trump administration, despite her requests for intervention. She said that Kobach has previously asserted that he alone controls litigation on behalf of the State of Kansas, and that the AG intruded on her “supreme executive” power as the head of the state’s executive branch.
"The lawsuit asked the court to declare that the governor’s office has the power to retain its own counsel to sue or join lawsuits if the AG refuses."
