She alleges the department and Education Commissioner violated her First Amendment rights by forcing her resignation in mid-September.
She posted “well deserved” under a Facebook post referencing Kirk’s killing during a Utah campus event.
She says she deleted the remark within minutes and later issued a public apology, the complaint says.
The filing says she received threatening phone calls and emails, including one titled “resign or die.”
Public officials also called for her firing.
In the lawsuit, she argues her speech was made as a private citizen and was protected by the Constitution.
