After SUSPECT was rescued from the Chevrolet, court records say he was given a preliminary breathalizer test, which came back as a 0.160%—twice the legal blood alcohol content level.
He was subsequently taken to a hospital for his injuries and arrested on suspicion of felony DWI involving the death of another, driving in the wrong direction of a divided highway, and imprudent driving involving an accident.
While at the hospital, he was asked to take a chemical blood test by state troopers, but he refused and requested an attorney, court records say.
Jackson County courts then granted troopers a search warrant, and hewas ordered to take the test. Court documents say the blood sample was taken back to the MSHP Crime Laboratory for analysis, but as of June 2025, the results have not been released.
He has since been formally charged in a Johnson County District Court, and according to his attorney, J.R. Hobbs, he has posted bond and "complied with the pretrial release conditions set by the court."
