Kobach urges state board of education to align school contracts with federal law
TOPEKA – (June 25, 2025) – Kansas Attorney General Kris Kobach sent a letter to the Kansas State Board of Education, urging immediate action to revise contracts for Child Nutrition and Wellness Programs to comply with federal law and recent court rulings. The letter, addressed to State Board of Education Commissioner Randy Watson and Board Chair Cathy Hopkins, highlights concerns over contract language that expands the definition of sex discrimination to include “gender identity” and “sexual orientation,” citing conflicts with federal executive orders and a recent U.S. District Court ruling.
“The inclusion of such language in school contracts is not only unnecessary but also contrary to federal law and the recent court ruling,” Kobach said. “I respectfully request that the State Board of Education remove references to ‘sexual orientation’ and ‘gender identity’ from these contracts to ensure compliance with Title IX and protect the privacy and safety of Kansas students.”
Kobach noted that Kansas Executive Order No. 19-02, issued in 2019, is inconsistent with federal law, including Executive Order No. 14173 (90 FR 8633) and Executive Order 14151 (90 FR 8339), which direct the Departments of Agriculture and Education not to expand the definition of sex discrimination to include gender identity. Additionally, a ruling in Kansas v. U.S. Dept. of Education found that redefining Title IX to include gender identity undermines the statute’s protections for biological females in education. The letter was sent to all members of the Kansas State Board of Education, emphasizing the need to align vendor contracts with the controlling interpretation of Title IX in Kansas. Attorney General Kobach’s action underscores his commitment to upholding federal law and safeguarding the rights of Kansas students.
