Is Kansas City Ready For Conviction Against Former KCPD Det. To Be Overturned?!?

Agree or disagree . . . Here's an inconvenient fact . . . 

The Jackson County conviction against a former KCPD Detective contradicts DECADES of case law and LIKELY won't stand up on appeal. 

Even supporters of police reform and advocates for more law enforcement accountability understand that the decision denied a myriad of legal precedent on the books. 

The more interesting question . . .

HOW WILL KANSAS CITY REACT WHEN THIS VERDICT IS OVERTURNED???

 From our vantage . . . 

A great deal of sloppy and bias reporting on this topic has led to confusion from the public.

For instance . . .

A lot of people don't know that Mr. Lamb was in the middle of a high speed car chase after smacking down his lady friend. 

And the question of a gun at the scene has been misreported and is now basically urban legend. Among many locals . . . Many wrongly believe that po-po planted a weapon . . . MSM hasn't bothered to debunk this misapprehension out of fear of seeming biased.

What's worse . . .

The KC FOP angers far too easily when talking about this case and they have been UNPRODUCTIVE AND OFF-PUTTING in their advocacy of the former detective. In fact, behind the scenes some of their membership talked openly about the tone of online discussion that had only proven divisive and merely stirred a pointless social media cauldron of antagonistic chatter targeting the court and prosecutors. 

Proving that discretion is the better part of valor . . . We noticed KC FOP toning down their act after the decision. 

Meanwhile . . .

The legal argument is far more interesting.

His appeal, which largely relies on an analysis of federal case law and downplays the issue of DeValkenaere kicking over a grill and other items to reach the backyard, argues that none of that matters because police have broad powers when investigating any crime to affect an interview or arrest, even traffic violations.

“This was a traffic stop,” the appellate brief said.

Kansas City police officer convicted in Cameron Lamb's death files appeal

KANSAS CITY, Mo. - Attorneys for Eric DeValkenaere - the former Kansas City, Missouri, police detective convicted of second-degree manslaughter in Cameron Lamb's shooting death - have formally filed an appeal. DeValkenaere's appellate attorney, Jonathan Laurans, submitted the 84-page brief Oct. 27 to the Missouri Court of Appeals for the Western District of Missouri.
