KSHB: Overland Park files motion to dismiss 41 Action News lawsuit petition

The city of Overland Park denied a request by 41 Action News for the completed Johnson County Officer Involved Shooting Investigation Team or OISIT report on the incident.

To date, now more than three years after the fatal shooting, the OISIT report has not been made public.

In a newly filed response to the 41 Action News lawsuit to obtain the report, Overland Park’s attorney Brett Runyon asks the judge to dismiss the petition and to make us file a new one.

Runyon claims our petition violates Kansas state law because it’s too long.

Runyon writes the only plausible motive for what he calls 41 Action News’ “grossly excessive” petition is to “create a media splash and generate news traffic on its website and other platforms, as well as creating an irresponsible and inflated claim for attorneys’ fees.”

The motion, however, does not address the substance of the lawsuit.

    this is not a "back the badge" cause. this is a citizen shot by the police and then a cover up. there were no bullet holes in the rear window of the car that the dead citizen was allegedly driving into reverse so that the officer feared for his life and shot a whole shitload of bullets into the vehicle and kid

    and the city gave the cop a big payout too

    only the most unthinking bootlicking reactionary could support a police slaying of a citizen like this one. this one is as bad as the Mo water patrolman who drowned that Iowa frat boy then lied about it immediately. cover ups are not limited government, guys.

  2. What did the parents expect the cops to do? If the kid was too violent for the parents to handle, he's probably too violent for a peaceful outcome when the cops arrive.

  3. the parents want the report released too. the parents did not expect the cops to shoot their son, is the answer to the insipid question. a police officer must use reasonable force. whether the force used in this instance was reasonable is a determination that must be made by someone other than the police themselves, or else we live in a police state. it is that simple. thus, this cover up is troubling.

    That's the key part of the whole statement. Is 41 asking for too broad a range on information and not clear in what way or how they intend to use such information. I'm sure there is a lot of medical information the parents would rather not see go public. A lot of family history they'd rather not be made public. In short 41 wants to have access to it all and I mean it all. There is a lot of information from this investigation that would serve to benefit nobody if it were to be released other than 41 getting you to view it and them being able to sell an insane amount of advertising at higher rates.

    How about 41 going after Sharice Davids in this manner for her lack of doing any real political work in her district. Throw Mayor Lucas into this same pile of exposing the so called truth hunt.

    This was a bad affair where there were no winners. I still say the majority of the blame falls on the parents.

    I have to side with Brett Runyon as in forcing 41 to make clear their intents with what information they seek and intent.

    Funny how the media pick and chooses what they think the truth should be brought out into the open about while ignoring that which should be.

    While the family may think and some of you commenters might think if there is nothing to hide here then it should all be made public. It's not so cut and dry as you might think and to release it all would not benefit anyone other than those who like to trash and dig into everyone's dirty laundry.

Every possible thing you may have done in your life exposed for all to see and sort through? I know for a fact you have things you'd rather not everyone in the whole country know about and be able to see as related to you.

  18. The cop gunned down an unarmed teenager backing out of his garage onto his driveway in his mom’s minivan.

    The minivan’s nose had cleared the garage door by about 4 feet. Then the policeman riddled the side of the vehicle and slaughtered John.

    Remember, the police were called by concerned teenage friends for a mental health check. No excuse.
