Missouri senator proposes to let drivers use deadly force against some protesters
Missouri State Sen. Rick Brattin, R-Harrisonville, wants to make it a Class E felony for any protester who interferes with or blocks a public road, according to a report from MissouriNet. Under his bill, drivers could use deadly force against these protesters, and ones who illegally cross or attempt to cross private property.

Part of the proposed bill would make blocking roads and highways a Class E felony in Missouri, or a Class D if done during a declared unlawful assembly. That's it. Here's the portion of the bill in question.
"A person commits the offense of unlawful traffic interference if, with the intention to impede vehicular traffic, the person walks, stands, sits, kneels, lays, or places an object in such a manner as to block passage by a vehicle on any public street, highway, or interstate highway. This section shall not apply to the blocking of passage by any person who has permission to do so from a government authority, who is a law enforcement officer, or who does so to direct traffic away from hazardous road conditions, an obstacle, or a scene of an accident."
Here are the declaration of the felonies.
"The offense of unlawful traffic interference on any public street, highway, or an interstate highway is a class E felony."
"The offense of unlawful traffic interference on any public street, highway, or interstate highway while part of an unlawful assembly is a class D felony."
Certain individuals and groups who oppose this bill are falsely claiming that drivers will be permitted to use deadly force against those committing these offenses simply because the offenses are felonies. This is completely untrue. While Missouri law does allow for use of deadly force to prevent felonies, it allows it only to protect against forcible felonies. These are specifically defined as "any felony involving the use or threat of physical force or violence against any individual, including but not limited to murder, robbery, burglary, arson, kidnapping, assault, and any forcible sexual offense". Anyone with any common sense can see that blocking a street does not meet this definition.
I oppose this portion of the bill because it is too broad and open to abuse by authorities. Simply putting a traffic cone in the road without authorization could become a felony offense. But I'm not opposed to it because of some bullshit disinformation that keeps getting repeated. Channel 9 needs to offer a retraction and be held accountable for publishing this.

Both State law and KCMO Code of Ordinances completely disagree with you. The "right away" belongs to vehicles except in very specific locations and circumstances.
