After streetlight falls on KC man's car, city refuses to pay, saying it's not liable for damages
KANSAS CITY, Mo. - It was a neighbor who told Parker McDaniels the bad news. "When I was going into my kitchen, I heard it," Stephanie Moutry said. The sound was the crash of streetlight lamp onto McDaniels' car. It happened right after Christmas on a quiet cul-de-sac near 99th Street and Holmes Road.

ReplyDeleteKCMO clearly negligent with maintenance on light pole. Won't pay for car (it is not worth $3200, so they should total it out), but they will pay hundreds of thousands to satisfy city worker harassment complaints.

ReplyDeleteThe owner of a street light is responsible for any damage due to it failing. Now if you have hit it and then it falls that's a different story.
ReplyDeleteDepending on the location, the responsibility for repair of malfunctioning street lights located within the City of Kansas City, Mo., can be the responsibility of either the City or the Missouri Highway and Transportation Department.

ReplyDeleteI wonder whether the owner or her neighbor informed the city that the pole was rusting out at ground level. If so the city may be liable for the damages because it failed to follow up.
ReplyDeleteThey will lose this in court. Better to settle now but KC isn't known for financially responsible decisions.
