Accordingly, this cryptic newsie tidbit was sent our way and it might or might not impact the local protest scene as demonstrators are clearly escalating their actions.

"The Missouri Bar has recently posted a lot of resources regarding what lawyers should do when they suspect their colleagues might have made an ethical lapse. This is valuable information and I'm not the only one who is reading it. What you don't know TKC, is that there are many attorneys who have pertinent questions about Stacy Shaw and her involvement in protests that have resulted in negative consequences for our community. Of course everyone remembers violent confrontations between police and protesters on the Plaza. In Westport there was a fire set in a public street and the doors of a bar were smashed. Last night some protesters engaged in vandalism against KC police headquarters. There are many common denominators in these protests . . . My colleagues and I notice Ms. Shaw's advocacy related to recent protests and her online messages as well. I do not think it's unfair to raise questions about how an officer of the court should conduct themselves during a volatile time of civil unrest. I am certain Ms. Shaw understands that participation in any manner of illegal activity is prohibited by the rules that govern attorneys in our great state. And I hope that she might be open to discussing her activity in a setting that's more professional than online chats and protests on Kansas City streets . . ."

To be fair to Ms. Shaw, is in fact arising star attorney. and she has been completely forthright and transparent about her legal standing and her work to represent clients - Many of whom have actively engaged in local protests.
In her latest response to Mayor Quinton Lucas, she offers a very informed and strident defense of her reasoning and protest advocacy.
As a public figure gaining prominence in Kansas City, we assume Ms. Shaw's heart is pure and her intentions are good.
Moreover, protesters are rallying on local social media circles to clarify Ms. Shaw's role in recent protests . . .

Readers of this blog and all legal eagles, scumbags, sportos, sluts, bloods, dweebies, motorheads, wasteoids in Kansas City understand that debate over ethics and potential criticism from colleagues is a very real cost of engaging in the public discourse regarding social justice as the American political conversation becomes more acrimonious and the voting public moves closer to the election.

Every American has the right to protest and assemble peacefully. You don't need a permit or permission. It is your RIGHT to protest.
ReplyDeleteAs for blaming everyone for the actions of a few. Group punishment is not a part of the American legal code. It's good to see lawyers getting involved in changing society. We need everyone to engage is a civil thoughtful discussion.
That's great but it didn't seem very civil and thoughtful to engage in vandalism on city property.

Hey now, more KC lawyers are probably going to get involved. You've got rich white kids from Mission Hills and Lawrence protesting and getting arrested. Charging their parents 300 bucks an hour is the American way.

ReplyDeleteHI TONY!!! I would first like to say that I would have NEVER thought my name would be in this publication. I am a huge fan! I really appreciate you taking the time to cover the protests and generally giving people a platform for political dialogue and questions. I am more than happy to make time for any conversations that anyone wants to have or give you an interview!
ReplyDeleteTo clarify, I am not a legal observer at protests. Legal observers (who are trained by the ACLU or National Lawyers' Guild) are completely independent from protests and are there solely to observe. They do not speak at all. I am there because when I went to the protest on the Plaza on Sunday, May 31st, I saw that there were at least 50 police in riot gear lined up against protestors who were mostly under 23 years old. They were not armed. They were throwing partially opened water bottles at the officers' feet to get them wet. I saw a protestor get aggressively maced for doing nothing wrong. I jumped in front of the protestor and got maced myself. After that, I attended every major protest as a mediator with police, educator, protector and speaker.
Today was my 19th protest since May 31st. I get there when every protest begins and I stay until the last protestor is gone to make sure they are not attacked by police officers. I personally do not approve of vandalism. I think there are more effective ways to bring change. Many people do not realize that there are between 8-10 groups and another 50 or so completely independent protestors at the larger protests. My focus at protests is on protestor safety from police and white supremacy groups and, when I can as a SINGLE PERSON, stop criminal activity. But, as a single person who is unarmed and without official authority, I can only do so much.
I am not paid a single dime for protesting or for my advocacy. Many people don't know that our law firm has been doing a significant amount of social advocacy over the last ten years including free community legal education, partnerships with nonprofits where we provide pro bono legal services, financial aid for felons wanting to get their criminal records expunged, and drivers license reinstatement drives. We are representing over 50 protestors pro bono. Now that the majority of the criminal cases have been dismissed, we are working on having their arrest records expunged.
I am firmly and steadfastly committed to dismantling systemic racism in Kansas City. I am not sponsored by anyone. I am not on any boards or commissions, do not belong to any organizations, and not running for office or any popularity contests. My statements are my own and are based on research which I provide to people when I speak. This includes relevant statutes/ordinances/case law, press releases, social media posts from the direct source, and credible news sources. I use public information sources that people can use to educate themselves.
The biggest impact that these protests are having is a change in our collective conscience. People are speaking out against systemic racism. We are shouting that we have had enough. We are openly and loudly demanding accountability from political leadership. We are protesting in the streets. Many of us are doing so for the first time in our lives. Once you have had that personal revolution, it changes everything and everyone around you. You stop caring about or desiring public affirmation. You are able to operate with purpose and without fear. I am not afraid of getting arrested. I am not afraid of being bullied, tear gassed, maced, or reported to any agency. I have done nothing illegal. I am acting in accordance to my own strongly held convictions and my ethical and moral obligation as a lawyer and an American. I regret and will apologize for nothing.
