"On Sunday, Jan. 19, 2020, Jahron Swift, 29, a “frequent flyer” with the justice system, opened fire at a bar near 40 Highway and Noland Road, injuring 15 people and killing Raeven Parks, 25.
"One local TV station broadcast footage of Peters Baker on the scene of the shooting, almost in tears, lamenting how something like this could ever happen.
"Peters Baker pushed the blame for known felon, Jahron Swift, off on the NRA and Missouri gun laws instead of accepting the responsibility of her own actions that included letting Swift walk free on weapons and drug charges instead of sending him up the river where he belonged.
"Nevermind that Swift shouldn’t have been out of custody, much less possess a firearm given his frequent arrests for felony drug and weapons possessions."
Now, here's the legal break down that deserves attention and examines the crux of a crime fighting controversy:
"Peters Baker dropped Swift’s 2017 weapons charges in anticipation of the permitless carry legislation that would nullify the charge.
"Let that sink in for a moment. We’re told over and over by court officials that charges cannot be brought against people in anticipation of a crime, but Peters Baker dropped charges anticipating the passage of legislation that was not yet law.
"Once again, epic prosecutorial fail by the top law enforcement official in the county and this time the consequences are tragic."

DeleteKC is great, I love this city, love the sports teams and love all the wonderful things that are happening. Just don't know why the first solution to every shooting is to take everyone's guns away. It's counter productive. That's never going to happen, we have to be more pratcial when we talk about stopping the violence instead of just hate and old ideas.

Peters-Baker's incompetence as a prosecutor will be even surpassed by her incompetence as the chair of the Missouri Democratic Party when their candidates get stomped state-wide in November.
ReplyDeleteKCMO needs to encourage the federal law enforcement and prosecutors to double or triple their efforts in the city and get most of these cases before federal judges, where the cases will be handled appropriately and the necessary sentences handed down.
People who are trying to live in these high-crime neighborhoods as well as the rest of the residents of the entire metro are tired of cowardice, incompetence, and endless excuses from the local "officials".

ReplyDeleteThis criticism of the Prosecutor reflects complete ignorance of how our criminal justice system works. Once it was clear that the Missouri's concealed carry law was changing, it was inevitable that the charges against him would ultimately be dismissed, so the Prosecutor did exactly what made sense, drop the charges before she wastes the Court's time.

ReplyDeleteA state constitutional amendment on the right to bear firearms does not allow nonviolent felons to carry guns, the Missouri Supreme Court ruled in a set of opinions announced Tuesday. ... The law prohibits any felon from having a gun.
Even though the cases were still pending when Amendment 5 passed, the opinion noted that what matters is the law that existed at the time the crime occurred.
How many of the victims had health insurance ? County would be money ahead by offering hood rats range time to become better shots.
