    You don't have to be a brain surgeon to know that borders must be controlled. But, since it was Trumps idea... we must do the opposite. Hordes of all kinds of people flooding into the country with no money, jobs, with diseases and can't speak English? who cares. We will blame Trump.

Congress gave that right to the President when it passed the National Emergencies Act, back in 1976. at that time, Democrats had large majorities in both houses of Congress. If Congress can muster a veto proof majority, it can nullify the declaration. Otherwise, your side is SOL.

  12. There is no act, emergency or otherwise, that gives the President power to re-appropriate funds authorized by Congress.

    The constitution is explicit. Congress appropriates, the executive faithfully executes. Diverting funds is absolutely unconstitutional and illegal. Period.

    Trump can proclaim an "emergency" (fake or not is a separate argument) but he still has no authority or power to spend money on an unauthorized project.

    Sharice keeps winning.

  14. 4:21, the President does have power to re-direct unspent funds, as he has proposed. From a law professor's article on the subject:

    "The key statutes are 10 USC 2808 and 33 USC 2293. Section 2808 allows redirection of Department of Defense construction funds that have not yet been obligated, under certain conditions. Section 2293 does something similar with respect to the Army’s civil works construction funds."

  15. Nice try, but wrong. The statute you quoted specifically states unspent and unallocated funds can only be moved from one military project to another. It's also required to be in support of the armed forces.

    The wall is not a military project. DoD has no jurisdiction. It's a Homeland Security item and border security is their department.

    In all of the emergency declarations since the 70s made under this law, no president has ever attempted to make an end run around the constitution by appropriating money without congressional approval. What's worse is this one was specifically debated and denied.

    Congress also has the right to terminate any emergency rights granted under the law. They wrote it and granted the powers. They can rewrite and restrict as needed.

    I'll guarantee this - if Obama pulled a stunt like this - the impeachment charges would already have been approved before the ink was dry on the emergency decree.

    Just because the US Army Corp of Engineers is assigned to a project, that doesn't change the designation. Last I checked, Lake Jocoma and Longview Lake were not military projects despite the corps involvement. The corp designs thousands of civilian projects, dip shit.

    Again, the emergency act doesn't allow for re-appropriating on any non-armed services projects. The wall project and all other border items have always been bundled to Homeland Security budget.

    As to Obama Iran "payment", there was nothing said because it was not taxpayer money. The multi national deal to deny them nukes included the release of Iranian money which had been previously frozen under US sanctions. It was their money we had seized and were returning.
