MIGHTY KRIS KOBACH SUPPORT DOOMS PREZ TRUMP BORDER WALL NATIONAL EMERGENCY DECLARATION!?!?!



After being completely smacked down, embarrassed and disgraced by granny Guv Kelly and the housewives of Johnson County, "Mighty" Kris Kobach completed his remedial legal classes, threatened a Senate run and now wants to help build the wall.

Never mind that that Kansas GOP fears Mr. Kobach will give away a Senate seat and can't believe they were forced to repeatedly endure the antics of a dude who would run around a parade with a toy gun.

Furthermore . . .

Notice that the Prez has yet to make good on those promises to bring Kris Kobach to D.C. and save the guy from the horrible work of rallying the right wing of rural Kansas.

Nevertheless, Kris Kobach remains at the forefront of the border wall debate after the U.S. House Democratic Party majority gave the Prez pennies on the dollar for a tiny wall that won't live up to promises.

To be fair, here's a glimpse at much more civilized conversation featuring intelligent consideration of immigration policy:

    1. Think about how many immigration cases he loses, the critical elections he has caused to turn to the Democrats. Kobach might be a Democratic Party operative in disguise because he is really good at blundering at the most inopportune times. Couldn't plan it better. Opponents of open borders should actually thank him for his service.

  4. Democrats don't have to worry about it , Republican land owners in Texas along the border will tie this up in court. Trump knows this and said as much yesterday in his insane press conference. He only knows because Hannity told him. Trump is counting on this being tied up in court, no wall being built, and eventually reaching the Supreme Court. For those of us who read and don't watch Fox News we know that Texas Republicans battling Trump over imminent domain will be very interesting. During this period of no wall being built Trump and Fox will be telling the cult45 followers repeatedly that Democrats are holding up the wall getting built. Not one inch of wall will be built between now and the 2020 election, which Trump knows so all this is is a diversionary tactic to buy time with his idiotic, gullible voters. The entire time he is campaigning he will be blaming Democrats for lack of progress on the wall and the simpletons will believe every word. Trump voters, you ever look at Scientologists and wonder how do they not see it, now are they getting suckered so bad? That's you with Trump.

    There is nothing like a "utility easement" under the Law.

    That's why there has only been electronic surveillance conducted there, and also why law enforcement has been much more effective in stopping illegal Border crossings in those areas than in the areas that only rely on physical barriers.

    Please note that one justification given for construction of the Wall is that all further electronic surveillance will become unnecessary.

    Last you goddamn rubes, there is a natural border called the Rio Grande between the U.S. and Mexico. That means the wall (that will NEVER be built) would have to be built on the U.S. side. I pretty sure Mexico won't let it be built on their land.

    Trump is declaring the emergency under the authority Congress gave to the Chief Executive in 1976 under the National Emergencies Act. Are you arguing that the Act itself is unconstitutional, or that the Act is find but the declaration is unconstitutional, or something else?

    Please specify.

  13. @ 2:45, all I'm doing is reminding people about what others have said in the past about the President's use of Emergency Powers.

    I'm also aware, as you should be,that the 1976 Act restricts him to the 136 specific powers granted by it or continued under the Act from earlier Emergency Resolutions.

    The only relevant power the Act gives the President regarding construction projects is the "construction of camps and cantonments as required", a part of the 1947 Resolution specifically continued in '76.

    He can mobilize armed forces and nationalize State Guard troops to be stationed along the Border for thirty days, but he has no powers under the 1976 Act to begin any other types of construction.

    Don't take my word for this, look the text of the Act up for yourself, but be prepared to have to spend some time referencing al of the 136 Powers it grants, some of them run back to 1932.

  14. The declaration in this case is unconstitutional.

    There is no emergency. Illegal border crossings are at a multi-decade low. Asylum seekers are turning themselves in, not attacking or sneaking in.

    Trump has talked about this issue for 2 years while doing nothing about funding. For the last 2 months he has threatened declaring an emergency if he didn't get his way in Congress. It was a long time in "scheduling" this emergency declaration, which is the definition of this whole thing being non-urgent. An emergency is something that demands immediate action. Trump's own actions have been of delay and waiting.

    In Trump's press conference, he told us he didn't have to do this. Again, if it's not necessary, then it's not an emergency.

    The act is specifically for a president to use for events that Congress can not act upon quickly. But here, they had time and made a decision. Congress has been debating homeland security funding for months and specifically voted to not fund a wall. In fact the mid-term elections were a referendum on illegal immigration, as Trump made it the centerpiece of his campaign stops for Senate and House candidates. They lost. Voters recognized there was no crisis.

    The constitution specifically gives appropriation power to Congress. The president can't change the spending just because he disagrees or wants a project done fast - which again, he admitted was his reasoning.

    The courts will strike down his actions.

  18. 9:12, the problems you mention, even if true, would not make the action unconstitutional. In fact even absent the Emergency Powers Act, there is good argument that the Presidency has an inherent right to take emergency action as the country's chief executive. Trump's declaration may run afoul of the statute and might be struck down on that basis, but it does not implicate the constitution to do so. The statute provides a means for Congress to void the declaration. Realistically it would take a veto proof majority to do that.

  19. 11:15, eminent domain because if you look at google maps aerial photos for Mission Texas you will see houses on the Rio Grand river with boat docks in front on the river. Where does the wall go there? And while your looking scroll west and look at the two damns and lakes with the border in the middle of the lake, where do you put the wall there? These are things normal people consider when they hear “build the wall!”
