Bait and Switch Meets First Amendment

In November of 2017, Merriam residents voted to approve a $30 million project to replace their outdoor swimming pool and community center.

In August of 2018, Merriam residents were shocked to learn the city leadership had replaced this with a $36.6 million (and climbing) project that includes shrinking the outdoor pool by more than half and relocating the Antioch library onto the site without the resident’s knowledge or approval.

Upset residents asked the city council to put this project on hold. The mayor and majority of city council members decided to represent each other rather than the residents.

The outrageous behavior and city's decisions triggered a response from many residents. The First Amendment gives us the right to “petition the government for redress of a grievance”. This particular grievance cries out for redress.

Volunteers went door to door to obtain the necessary signatures. The petitions were notarized and the signatures validated against official voting records.

The three petitions, in summary:

1. If you are going to spend more than $1 million in TIF, you have to ask the residents first, by vote.

2. If you are going to give, sell, or transfer Vavra Park land, you have to ask the residents first, by vote.

3. You must replace the pool with something equivalent, just as your promotional literature for the vote indicated.

Thanks to everyone who signed the petitions and thanks to the more than a dozen petition circulators who went door to door in the heat, cold and even snow storms gathering signatures from September 15, 2018 to January 13, 2019.

  1. More and more it looks like petitions are the only way to get goverment's attention. Not just symbolic ones but real, binding agreements that force a public vote. Already, even Republicans want to limit this power and raise the threshold in Missouri and Kansas.

  3. Sounds a lot like KC's airport imbroglio. Let citizens vote on a specific plan, then take their assent as a carte blanche to do something completely different.

  5. We had a couple of votes over here on the streetcar ; 1 banned expansion, 2 required a city-wide vote before monies were expended on an expansion.... both are being ignored. Democracy is so overrated.

    Dan is a great guy, he should run for mayor again. He is a great voice for our community!
