Clay Chastain Legal Battle Against City Hall Continues . . .



Highlight of the latest note from Clay and what seems like a progress report regarding his legal battle that might not be going well for him . . .

Transit Activist Note: Failing strong arm gov't tries desperate legal tactic to escape Clay Chastain's defamation suit while the Star looks on . . .

A vengeful City government (overseeing a stagnant, crime-ridden city with busted infrastructure and too many taxpayer-subsidized glitzy projects that favor the elite) tries to retaliate against a citizen it doesn't like, while the KC Star looks the other way. A town is only as good as its newspaper. Kansas City needs a new government and, a new 'paper for the people.'

Fact: Sly James, the City and the City's legal dept. do not like Clay's light rail petitions interfering with and challenging the City's plan to fix transit with an obsolete novelty downtown streetcar system designed for tourists and wealthy developers. So, this triad of power thrice sabotaged Clay's valid light rail petitions (2011,2015, 2017), after the City ignored (and repealed) the stated will of 75,000 voter who had earlier (2006) approved Clay's light rail petition initiative

Fact: Sly James did not like the fact Clay tried to get him disqualified in the 2015 mayor's race for consistently being delinquent on paying his city taxes.
Fact: Sly, the City and the City's legal dept. hatched a scheme to try and harm Clay, defame Clay and retaliate against Clay (for political purposes) by deliberately and improperly ordering its security force to place Clay on the City's SECRET "Watch List" for individuals the City deems "possibly dangerous." This resulted in Clay being unduly harassed, searched and delayed, intimidated, humiliated and placed under ARMED security guard while at City Hall over a 3.5 year period.

Fact: Though impassioned to try and help improve Kansas City, Clay is a non-violent peaceable family man who has NEVER physically harmed anyone nor threatened anyone or any institution with violence.

In the lower circuit court, the City claimed it was immune from liability from Clay's defamation claim by the doctrine of sovereign immunity. But twice, the Honorable Judge Kevin D. Harrell has denied the City's Motion to Dismiss Clay's suit and set the case for trial. Afraid of being exposed and penalized for its crime, the City has now filed an extraordinary "Writ of Prohibition" (in the Western District Court of Appeals) to get that court to overrule Judge Harrell and get the City off the hook by leap frogging over the entire lower court process before a trial can even take place.

If Kansas City's City government is protected from suit for deliberately and improperly using its security force to harass, harm and defame an innocent citizen it feels politically threatened by, then what is left to protect the people from such an oppressive-acting government? Surely, not the city's faithful watch dog, the Kansas City Star, who has ignored informing the people of what's going on.

And do all the City Council men and women, running for mayor, know what is going on? And do these elected officials support these improper actions by the government they represent?

  2. I really and truly don't get it. Heck, some of Clay's political stances I agree with. Toy trains everywhere, I don't. But, what in the heck is his rub? He hasn't even lived in the State for a decade or so? If he's so invested in betterment of Kansas City, move back and do it. If he's so desperate to be a political power player schmoozing around the City, move back. As is, he has no effect on policy, only costing tax payers for his stupid lawsuits against a Tammany Hall that hates his guts.
