Safer Local Living Space: Council Lady Jolie Justus Helps Abuse Victims Escape Dangerous Kansas City Housing Conditions
Credit where it's due, here's an important and worthwhile readjustment of local policy by Council Lady Jolie just in time for election season.
Again, this legislation tweak is reasonable and includes important conditions to try and limit abuse but it also looks great on a campaign flyer.

Ordinance #180516: Amending Chapter 50, Code of Ordinances, entitled Offenses and Miscellaneous Provisions, by repealing Sections 50-109 and enacting in lieu thereof a new section of like number and subject matter which allows a victim of domestic violence, sexual assault or stalking to terminate a lease agreement.
Money line:
"Any tenant or his or her dependent that is the victim of domestic violence, sexual assault, or stalking, may terminate a lease and quit the premises upon providing the landlord written notice and a copy of any order of protection issued for the tenant or the tenant’s dependent pursuant to state statute. Any landlord or his agent who acts in violation of this section shall be deemed guilty of a violation of this section."

How could one prove you are being stalked to get out of a lease agreement I ask myself. If the tenants learn to take advantage of these laws it will just make the rents go up higher then they already are.

ReplyDeleteMany landlords with proof would allow a tenant to move if proof of such actions and need of security by relocating was needed. But moving a few blocks or miles away isn't going to make you any safer than maybe staying put would. But nonetheless as I said many would allow the move but the tenant needs to understand they are breaking the lease and will forfeit their deposit and still be responsible for any money owed for rent and damages.

But as a whole, the amending this ordinance is a huge waste of time and not a issue that will in anyway improve living conditions in Kansas City. Just more smoke and mirrors from elected officials trying to willfully misrepresent the masses with intent to deceive the residents of their districts that they are doing real city government work for the better of all.
I support this legislation. It’s important to have mobility without restriction to leave if you feel like your life is in danger without being obligated to go into further debt to survive. One of the few things I have agreed with in nearly 8 years of the Sly James Administration. This is very important.
ReplyDelete^^^^^^ What you fail to understand stupid is nobody can make you stay. The legislation is another stupid move by the city. Your landlord isn't responsible for your legal issues while you're responsible to him per a lease you signed. The city has no right to interfere with a signed lease unless building codes or illegal criminal acts are taking place on the property and then, and even then, I don't think in a civil court they have a leg to stand on. This is a bullshit as Dave says Foo Foo bunch of crap from a loser in the Mayor race.
