Here's today's ultimatum from Kansas City's most strident transit activist . . .
Clay Chastain issues Notice of Intent to recall Kansas City Mayor Sly James
Today I issue a Notice of Intent to commence a petition drive to recall Kansas City Mayor Sly James from office for his multiple acts of fraudulent misconduct against valid petitions from the people.
Ideally, Kansas City's government should be working with its citizens, not against them. Kansas City's government should welcome citizens who care enough and have taken their time to design and circulate petitions that seek to offer the community assistance in how best to move the city forward.
And assuming a citizen's intent is sincere, and that individual is playing by the rules outlined in the city charter for placing petition questions before Kansas City voters, the focus should be on the what is the idea not who is proposing it, or where that individual resides. It is ideas that will move Kansas City forward, not who is behind them.
Unfortunately Kansas City Mayor Sly James, since he first took office, has been hostile to, and sicked the city's legal staff on, valid petitions from the people that challenge his leadership. Especially petitions submitted to the city from Clay Chastain. As the leader of the city, Mayor Sly James is responsible for the multiple acts of fraudulent misconduct directed by the city against valid petitions from the people. These dark, un-Democratic and un-American actions have had the affect of undermining those petitions and manipulating the results of the following Kansas City petition elections...
1. Sly's manipulation of the 2014 Light Rail petition election in which he led the city in placing fraudulent petition ballot language before voters that not only did not reflect the substance of the petition proposal itself, but was also in clear violation of Section 712 of the City Charter which reads the petition ballot language is to be..."a concise and unprejudiced statement of the substance of such (petition) ordinance.." Sly's James' ballot language for the Kansas City, Missouri 2014 Light Rail Petition Election did not even mention the words light rail!
2. Sly's manipulation of the 2016 Light Rail petition election in which Sly fraudulently set up me, the Committee of Petitioners and our Attorney Jeffrey Carey by fraudulently instructing the (former) City Attorney Bill Geary to lead us to believe the light rail petition was lawful before we began circulating it only for Geary to later (after we submitted the petition to the city) give public testimony to the city council, media and public that the light rail petition was "illegal" and thus could be repealed by the council, if approved by voters! This dark cloud orchestrated by Mayor Sly James, suggesting the people were voting on an unlawful petition, hung over the campaign and negatively affected the outcome of the election.
3. Sly's manipulation of the up-coming Kansas City August 8 transit petition election in which Sly has led the city, yet again, in placing fraudulent petition ballot language before voters that not only does not reflect the substance of the transit petition proposal signed in support of by Kansas City voters, but is also in violation of Section 712 of the City Charter as stated above. The city's ballot language says the transit petition proposal is for the..." purpose of constructing, maintaining and operating one or more extensions to the streetcar system..." The petition ballot language (in its "original form") begins..."Transform the city's downtown streetcar system into a more rapid rail system (operating at faster speeds, with fewer stops and predominantly in new transit greenways separated from traffic) and also expand it into a more citywide streetcar system by adding 4 new lines..."
Obviously the substance of the petition is to transform the city's downtown streetcar system into a rapid citywide rail system with the rail cars running in their own right of way, and not in traffic, and along 4-specified routes with connections to a new electric bus system and bikeway network. The city's fraudulent and deliberately vague and incorrect ballot language suggest the transit petition merely calls for extending the city's downtown streetcar system, and how it currently operates, in whatever direction suits Sly.
This petition drive to recall Mayor Sly James from office for his multiple fraudulent acts of misconduct against valid petitions from the people (as stated above) will be cancelled under one condition:
* The city council will immediately move to seek a court order for the purpose of withdrawing Question #2 from the KCMO August 8 ballot, and replace it with a new Ballot Question #2 that states the transit petition proposal in its "original form" as found in City Ordinance No. 170043 and required by Section 702 of the City Charter.
We do not take lightly this radical action to attempt to recall Kansas City Mayor Sly James from office. But we have tried repeatedly (to no avail) to get the city to do the right thing and place before voters ballot language that correctly and fairly represents the "substance" of the people's valid transit petition proposal that the city is required to do according to City Charter law.
My foremost duty, as a petition-oriented activist, is to protect Kansas City's Democratic Petition Process from being rendered meaningless by Kansas City Mayor Sly James.
