Legal move trickery with no opposition moves the toy train past another hurdle as proponents of the extension that was ALREADY REJECTED BY VOTERS A MERE TWO YEARS AGO is now back on track.

KCRTA: 16th Circuit Court waives judicial hearing in streetcar case

On Aug. 19, the 16th Circuit Court held a status conference on the streetcar extension case and KCRTA asked the Court to forego the judicial hearing as permitted under the TDD Act when no one files an opposition in the proceeding.
Under such circumstances, the court can make its ruling based on the pleadings alone. The judge decided to do so.
The TDD Act expressly permits this when no opposition to the legality of the proposed district needs to be ruled upon by the Court. Considering that two prior courts have reviewed this same structure and finance plan before and found them to be lawful, we anticipate that this proposed district will be certified for voter consideration by the Court as were the prior proposals.
This only affects the judicial hearing that would have been held on Sept. 16. The Court will still hold the public hearing on Sept 15, as previously noticed. Assuming the Court certifies the district for voter consideration as anticipated, the Court would issue that order sometime after Sept. 15.

8:02 If 50 people had been in opposition on this mater I seriously doubt it would have had any effect. The fix is in and if the voters don't get out and kill it and kill it again the next time if rears it's ugly head.

ReplyDeleteDoes anyone know how big the Federal grant will be for the expansion? The feds are paying for half of the cost of trolley systems in other cities. Our trolley folks need to be doing their work in Washington DC. Before there is any thought of another CID vote, there needs to be an explanation of what the Federal participation will be.

There's no guarantee that even if 320 people vote for it like voted for the downtown streetcar that the feds will kick in the money. Barry will be out of office along with his trolley boy Sec'y of Transportation Fox. No telling at this point what the situation with giving money to losing g causes in KC will be a year from now. A vote for Trump is a vote aginst streetcar expansion for sure.
