ReplyDeleteRon Berry's termination issue was his clear violation of the harassment policy that is in place to protect the interns. If he would have followed the policy and reported it in February, the issue could have been addressed then like it should have. He admitted he chose not to follow the senate policy and his termination was more than appropriate for that and many other reasons according to people that know.
ReplyDeleteThe Workplace Harassment Policy of the Missouri Senate provides, in pertinent part, that "supervisors have a responsibility to promptly report workplace harassment or complaints of workplace harassment to the Senate Administrator."
According to the Senate investigator's report released on July 22, the intern in question requested to and did meet with Ron Berry on February 2, 2015. During that meeting, she described to him an incident that she claimed occurred on January 26th in which she claimed that she was subjected to inappropriate conduct, including that she was subjected to unwelcome requests for sexual contact. However, Mr. Berry failed to promptly, or ever, report the incident to the Senate Administrator or any other party. Although the intern specifically requested that Mr. Berry not report the incident, the Senate's Workplace Harassment Policy does not provide for an exception to the reporting requirement where the alleged victim requests that a report not be made. The policy is reviewed and agreed to and signed by every senate employee and Mr. Berry reviewed and signed off on his agreement to abide by the policy. The policy exists to take immediate action on complaints to be able to investigate complaints and mitigate any issues. It is unfortunate that the issue was not dealt with at that time but Mr. Berry clearly violated the policy at the detriment of the intern and the Missouri Senate. For that reason alone, he should have been terminated or the Senate Administrator would have fired him. Agree or disagree with LeVota, but this call was the right one.
