CITY COUNCIL DEVISES INCREASED PROTECTION ORDER SECURITY BEFORE COURT DATES TOO!!!

It's a simple but important tweek in the law that attempts to enforce some distance BEFORE the waiting period when these matters usually go to court.

Take a look:

Ordinance #140711:

WHEREAS, orders of protection are initially entered as ex-parte orders of protection until a hearing is held and a full order of protection is entered; and

WHEREAS, Section 50-47 as enacted on August 21, 2008, only allows for violations of full orders of protection, and not ex-parte orders of protection, to be prosecuted in the City of Kansas City Municipal Court; and

WHEREAS, in the interest of public safety, it should be possible for both ex-parte and full orders of protection to be prosecuted in the City of Kansas City Municipal Court;

Quick layman's explanation of the language . . . Missouri seyz an Ex Parte Order is a temporary order that lasts only until a hearing is held, which should be held within 15 days. So, this bit of stop-gap legislation is important for a great many residents struggling with domestic drama which is usually exacerbated during pro sports playoff season, extended weekends and the holidays . . . And once again TKC drinking alone in the basement seems like a wise choice.

    This is a terrible move and one designed for the city and not the victim. Fact is a city court can not deal with felonious activities, nor can it issue orders that extend beyond it's legal authority, which is dealing with infractions, misdemeanors and generally none serious offenses. A city judge is very limited as to sentencing - generally max jail time is a year. The city council can not grant a city court the authority to try felons - only the state can do that. So again the city will be shit canning felony cases and charging them as misdeameanors just so they can keep the fine money in the city piggy bank. The city already does this with many felony thefts and the victims are getting screwed while the city goes to the bank. This makes as much sense as Slys gun court - which is never going to happen.

    This ordinance is more about city money making than protection of anyone. We already have scores of cases involving city employees that are swept under the carpet. Just imagine what it would be like if the city courts could join in. This idea provides little protection to a victim of domestic abuse who deserves to appear before a magistrate who has the authority to throw the book at an offender. That will not happen in city court.

    There is also an additional issue with Federal firearms laws. Under current Federal law any person subject to a restraining order or exparte order related to domestic abuse can not posses firearms. A person convicted of a domestic abuse violation can never own or posses a firearm. If a city misdemeanor court issues the order there are legal questions as to how a person may be lifetime barred as a result of a city court issuing orders or finding someone guilty of a misdemeanor infraction.

    This authority needs to stay 100 percent with the state.
