Weird Stuff Antiques and Thrift is a Kansas City institution and a local hidden treasure that makes urban core shopping unique. Sadly, owner Terry Sanchez is currently engaged in a fight for survival against a disputed Bank of America foreclosure effort that could close his beloved biz within a matter of days.
We plan to write more follow-up on this story but the deets of this controversy are important for Kansas City Sunday shoppers and small biz owners.

OWNER TERRY SANCHEZ SAYS THAT BANK OF AMERICA IS FORCING A FORECLOSURE DESPITE THE FACT THAT HE'S NEVER MISSED A LOAN PAYMENT!!!
In an EXCLUSIVE interview, Terry seemed flummoxed at the strange financial tactics that seem misguided and haphazard.
The KC Small biz owner told us: "When I first questioned BOA, they said that I was behind in my payments. I was able to show them that was absolutely incorrect. So then, they tell me that a tax bill was overdue and that's why they wanted to take my building."
Here's why this is important . . . Most small biz owners know that they can slide and delay Kansas City area tax payments for just a bit when times are tight and they don't face immediate sanction. This bit of cushion can make or break a biz and it's important for locals to understand that the tiny bit of leeway has always existed.
However, BOA is using this slight lag as a pretense to take a property worth more than a quarter of a million bucks.
"I have a lot of equity built up in this building. It's basically something I've worked my whole life to maintain. I've since paid my tax bill but BOA refuses to change their mind and they're ready to take my property under very questionable circumstances," Mr. Sanchez said.
Now, Bank Of America has had their own foreclosure trouble and Terry thinks this power play comes from overall pressure to make up corporate losses.
However, KC Biz owners should know that one of their colleagues who is UP TO DATE IN ALL OF HIS PAYMENTS now faces foreclosure because a bank that recently benefited from taxpayer bailout has now decided to play hardball and change their tactics.

This guy owed (actually still owes, no record of payment has been posted) $7K+ of taxes for 2012 and 2013.
But he does keep the taxes current on his 67 Camaro, 69 Mustang and 67 Trans Am.

ReplyDeleteI know a guy who was behind on his mortgage payments, got a notice of possible foreclosure proceedings if not paid in full by, and then when he went to pay it all current BOA wouldn't accept cash.

ReplyDeleteIn KCK, they send in the sheriff's swat team to take care of these matters. Steal everything you own, pretend to sale your stuff at auction. If you can find a lawyer, you have to fight for your life. Lawyers do not want to fight the mob.
ReplyDeleteSure you can show your loan payments and tax are current, but when dealing with swat punks, you're guilty until proven broke. Their job is to break down your door, put a machine gun to your head and steal your stuff. End of story.
I've researched and interviewed several victims and find some one wants the property. A bankers developer pal or a city jerk off for a future deal that will stuff cash into their pockets.

Why would you pay 7k in taxes when you are trying to sell the building. Just make it part of the sales price. BOA just sees dollar signs in forclosing.
ReplyDeleteJackson County begins it's lien/foreclosure process after the third year of delinquency. Then BOA will be forced to put up what Terry has owed all along, plus some hefty interest.

Trust me, BOA doesn't want this properties as inventory, that's why they want him to live up to his responsibilities.
BofA is total fucking abortion of a financial institution they should have been left twisting in the wind during the financial crisis. They are so far out of control. I am not one for a lot of gov't. regulation, but BofA should have been forced to restructure after '09 into a 10 bank branch, they are far from being a legitimate financial institution.
ReplyDeleteI re-fied my house with BoA last year, got a great rate (they had bought my loan from Cap Fed about 7 years ago)and the promise that they wouldn't sell my loan.
ReplyDelete30 days later I got a letter from Fannie Mae telling me that they had bought my loan from BoA, but I would still be paying BoA as they were servicing my loan for Fannie Mae. I kinda freaked out as I didn't know what was gonna happen. Talked to a few friends in the real-estate biz and they told me that I was now in a much better position not having my loan with BoA because now I would have more protection against the type of unethical shit BoA has been doing to other folks who had mortgages with them.
So...I felt much better.
My loan payments are due at the first of the month, but I can wait until the 15th before I get dinged.
Anyway...I made my first payment to BoA on my new mortgage 2 days before the 1st of the month and they had the balls to ding me with a "You paid too early" fee.
What a bunch of fucking crooks. Meanwhile our politician's are too busy raking in dough from banks to stop all the stupid shit they do to their customers on a daily basis.
Hopefully Terry can get this straightened out without getting screwed.
Never, ever do business with Bank of America. They are crooks, unorganized and any affiliation with the Bank will come back to bite you. You heard it hear first.
ReplyDelete3:57, I agree. They are the most customer unfriendly institution I have ever encountered, and if they can figure out a way to screw you, they will do so.
ReplyDeleteBofA could get away with it in California because at one time, there were only abour 6 big banks in the state (neighborhood banks were unheard of out there).
Since they have gone national, they can't get away so easily with some of their practices, but that doesn't mean that they won't try.
I stopped doing business with BOA years ago. It seems that anytime there is a new fee designed to screw the consumer out of money Boa comes up with it. Then other banks adopt it after seeing how many customers BOA loses after their patrons get tired of getting screwed once again.
ReplyDeleteNo one in their right mind does business with BOA. They are absolutely the last bank, or lending institution that a consumer would ever want to have an account with, or get a loan from. Ask any Realtor who's done business with them and would bet they would have horror storiesto tell.

ReplyDeleteI banked at BOA for years as a premier customer...no fees, free checks, no overdraft fees, red carpet service. Had my mortgage there as well. One day I got a letter saying they no longer considered my mortgage as part of our "financial relationship", and if I wanted to retain premier services I would have to add more money, such as using their investment services. I called them (and wrote to the president) and said why in the hell would I take investment advice from a bank that needed a TARP bailout? They had no good answer.
ReplyDeleteI refied my house with a local bank and am back to being a premier customer and getting much better service and rates. BOA sucks big time.
That store has the biggest accumulation of worthless junk I ever saw in one place.
