
Over the past 24 hours we've been getting a TON of feedback regarding Kansas City Red Light Camera FAIL . . .
Here's a detailed note . . .
"TKC, take a look @ the Missouri Court of Appeals Western District ruling against the city . . .
"This opinion this morning destroys the new proposed ordinance as well, as it renders "rebuttable presumption" unconstitutional if they want to apply in a criminal ordinance, plus this decision allows the class action and monetary recoveries from ATS and KC to go forward, This ruling also says they have to assess points, which the new ordinance chooses not to do."
And then . . . Another insider informs us . . .
"Councilman Scott Taylor really should know better in his work on the subject. He's a lawyer and he should be the first to realize that his attempts to save the red light cameras are intrinsically flawed. This is a problem that needs to be addressed at the state level and KCMO elected officials are only making things worse . . ."
Furthermore . . .
There's a great many readers who want to make it crystal clear that they plan on continuing to obey traffic laws but simply oppose red light cameras because of the shaky legal framework they reprsent and how it has been so easily adopted by Kansas City's political class who seem to care more about generating revenue than protecting the rights of residents.

ReplyDeleteThat "he's a lawyer" line is bullshit. Lawyering is a trade. You learn as you go and you learn , very specifically, what you need to do your work. If lawyers knew it all, there wouldn't be a need for civil courts. Everything would already be known.

ReplyDeleteThe city pushed this damn red light camera down the PD's throat. This was back in '04 or '05. We didn't want it then and said it was unconstitutional but they insisted. Now here we are...proven right...but at what expense? Idiots!!
