It's the illegal ones we have a problem with. All,Kobach is trying to do is reform our immigration laws so we can cut down on the uber of illegals and get control of our border. ReplyDeleteKOBACH office has numerous times been notified about notaries that signed fraudulent loan documents without the borrower being present in front of the notary.
ReplyDeleteNotary staff Diane Minear allegedly has a sweet spot for these types after proof provided of their deception. Amazing KOBACH was worried about Voter Fraud and IMMIGRATION, but ignores documents provided showing notary fraud.
The notary worked for Chicago Title and then tried to place blame allegedly on the VP of the Title plant for using her notary stamp to clean up a fraudulent loan documents allegedly adding names that borrowers did not sign themselves. Although signing documents as (A.C.)
There were even notaries done by this person Kobach office defended 44 days after loan had closed. Showing up as loan Modification with different money amount from original loan held by Blomquist.
Thus never registering the mortgage until 41 days later leaving loan open for mischief and fraud.
Allegedly switching borrowers fixed rate to and adjustable rate.
Loan closed 41 days earlier. Allegedly Notary & Argent Mortgage Broker Dan Messersmith & Steve Hooks Mortgage Professionals were using folks loan applications to induce lenders to issue funds to an escrow account opened the very next day after loan application filed out. So unreal and so illegal!
Allegedly over $600,000 was sent to Commerce bank CTIC escrow holder allegedly in a scheme to enrich others.
Insurance was even placed on property three weeks before borrower notified that loans was approved and escrow acct open the next day after applying for a loan
Loan documents revealed thru multiple fees & closing documents HUD statements the Notary filed all loan applications (5) three showed a fixed rate with Mortgage professionals John Brown, and (2) adjustable rate loan applications, now showing Messersmith switching roles becoming Mortgage Professional employee while at ARGENT Mortgage.
Both Judges saw this fraud and ignored it nor reported to higher authorities.
Allegedly it appeared by resubmitting fraudulent applications & switch info contained in Chicago Title closing files, was aware of the fraud and their chief legal counsel D. Blomquist concealed the info after he was asked for by borrowers to see the closing file after they suspected fraud occurred.
Blomquist allegedly admitted in letter That the adjustable rate loan application was signed the same day as the loan closed. All the while Blomquist knew about the allegations of fraud (5 charges for ALTA policy that have yet been given to the borrower, over charges for recording mortgage and fees that were not authorized and then gave documents to STJ law firm to foreclose.
notary even showed up at court as witness for STJ law firm and presented the fraud to Johnson County Judge who went with it after seeing multiple HUD statements, the notary reading a letter from KOBACHS office exonorating her of wrong doing.
Memo from R. Roe JOCO Atty dated June 4 proved notary not truthful. He wanted to see documents & allegedly had others sign them at his office not Chicago Title, then faxed them back to CTIC on June 6.
Documents show CTIC # Judge had requested all defendants exhibits turned in for review before trial. Seeing ALL FRAUD and he received STJ atty exhibits which contained fraud.
Notary states seeing all signers on June 2. Untrue. Judge refused to allow Roe's memo to be read at trial stating Hearsay. This would have exposed the notary. Fed law states business memo not hearsay.
Memo was not hearsay and judge was in error but allowed notary to increminate CTIC employee who later stated all loans closed in Kansas never went to a title plant.
Later CTIC hires an attorney
to defend Blomquist & notary after borrower files suit, judges uphold fraud.
Chicago Title allegedly was not registered with the Kansas Dept of Insurance in 2003 nor were escrow agents allegedly until the last few years.
nor were they properly registered at KS Sec of State.
