This just in . . . Check a great example of horrible Kansas City planning in the midst of a City Hall cash grab from neighborhoods.

JUST A FEW MOMENTS AGO, A KANSAS CITY COMMITTEE WAS FORCED TO CANCEL THEIR MEETING DESPITE THE FACT THAT A BUNCH OF IMPORTANT POLITICOS AND POWER BROKERS IN ATTENDANCE!!! 

WHY?!?!?

BECAUSE THEY DIDN'T SEND OUT NOTICE, A FEW EXTRA COMMITTEE MEMBERS SHOWED UP AND A FEW OTHER ISSUES . . . IT WAS AN ILLEGAL MEET-UP!!!

In the opening moments of the meeting Council Dude Scott Wagner was forced to wait outside because there wasn't notice for a City Council quorum.

Thankfully, Neighborhood Tourist Development Fund Chair Dona Stephenson raised her concern about the illegal nature of the meeting.

THE EXCHANGE BETWEEN COUNCIL LADY JAN AND MS. STEPHENSON WAS A BIT INTENSE!!! MS. STEPHENSON ASKED: "SO YOU ARE PREPARED TO GO THROUGH WITH AN ILLEGAL MEETING THAT VIOLATES SUNSHINE LAW!?!?!" AT THAT POINT COUNCIL LADY JAN BACKED DOWN!!!

Convention and Visitors Association associates tired to find a way to keep the conversation alive but nobody wanted to leave the room and the group decided it would be better if they did things the right way and sent out notice of their gathering.

From the crowd, there was a question over transparency.

Council Lady Jan responded: "Of course we want to do our very best to keep things open and transparent so we will go back and put out notice of this meeting on the City's website."

With that everybody got up and broke into a few private conversations . . .



What's important . . .



TKC TIPSTERS TOLD YOU THIS MEETING WAS ILLEGAL BUT YOU DIDN'T BELIEVE US!!! WHY DIDN'T YOU BELIEVE US?!?!

Another VERY SMART guy I talked to attending this meeting offered a bit of explanation about how this whole thing is really related to TIF money and the well of Kansas City funds drying up. We'll get more detail and post that one later.

In the meantime . . .

The CVA cash grab of neighborhood money is delayed for just a little longer thanks to AWESOME TKC TIPSTERS keeping track of public information much better than local politicos and power brokers.

    There were at least three things that made the meeting illegal.

  11. Jan and Co. got caught in the act of trying to have an illegal meeting to stuff more money into the CVA coffers. The sponsors of this ordinance sit on the CVA board and this is a direct conflict of interest. The meeting was illegal because there was a quorum of the NTDF meeting. The fact that the Finance Committee chair tried to violate the Sunshine Law is beyond belief.

  13. I'm awardee of NTDF funding. It has help me put on an annual event which draws thousands of people across Missouri and Kansas to Kansas City. I have watch the NTDF funding for many years. I think the real reason CVA is coming after NTDF funding now is because Kevin Spinelli is no longer the chair of the NTDF board. The last 20 years Kevin Spinelli chaired the NTDF committee he ensured that CVA would receive at least $500,000annually for its mulitple projects. Kevin was finally removed this year by the Mayor so now CVA does not have any croonies on the board to get the funding. CVA is afraid they actually have to be accoutable and explain thier projects just like every other organization that go before the NTDF board.

  17. Pistilli was a great chairman of NTDF. The reason the CVA is begging/grabbing/stealing money from NTDF is because three of their board members, who are also City Council members, are working to make it happen.

    TKC hinted at the reason behind the grab, and it involves TIF. TKC is on the right path.

  20. KC Star has yet another article about that Lee's Summit shooting of a 13 yr old girl but still no mention of the gun owners name. Obviously a well connected person, probably associated with law enforcement in one way or another. 500 block of Castle Drive...is all they mention in their "ongoing" investigation. More like cover-up if you ask me. How long does it take to figure out who owns the gun?

  29. NTDF is an appointed recommending body, in the same vein as PIAC and other commissions and committees. Consequently, their meetings legally have to noticed to the public and the press. To fail to give 24 hours notice was a mistake by Marcason, who should know better.

    It was a thinly-veiled attempt to continue the CVA money grab that Marcason is pushing through without NTDF committee feedback, and with faulty stats. Even Scott Wagner, co-sponsor of Jan's shady ordinance, and the one who defiantly challenged citizens last week to "look at his numbers" admitted today the numbers were bogus.

    This is nothing but a very non-transparent way for Jan to feed her friends. Hopefully the supreme embarrassment of being caught trying to violate the sunshine law will set her back on her heels and give her pause before she tries something so shady again.

    Just because public officials are appointed to an organization doesn't make it a "public body" for the purposes of applying the Missouri Subshime laws.

    In fact, the CVA is 501(c)(6) organization- a business league. They are a private corporation organized to promote civic and educational purposes. No different than any other private not-for-profit in this town.

    Th relationship between the CVA and KCMO is contractual, and public officials are appointed to it per contract and the by-laws of the CVA. So it's fair game if one wishes to examine that relationship, and whether the City complies with it's own purchasing and procurement policies in engaging the CVA, and whether the CVA is in substantial compliance with it's contract.

    But Sunshine law doesn't have a thing to do with the CVA- unless a quorum of the Council or one of it's committees is both there AND discussing public business (by the way, was"bowling night" properly noticed?).

    I know these facts may get in the way of the screaming red all caps headline with the word "illegal" prominently used, but it's bet to fire bullets at a real target.

    Like what is actually going on in this dust up for money between the usual East side grifters, here represented by CM Reed and Ms. Stephenson, or the CVA swells and their elected proxies.

The fact is any board and commission that is required to post a meeting notice under the Sunshine Law is well aware of that requirement and every member who is subject to it is well aware of it. Elected officials are subject to the Sunshine Law unless they are out of town. Where this all goes wrong is when someone isn't taking responsibility for who's attending and people show up (elected officials) without letting anyone know they are coming. It is a serious enough matter that someone should have covered their bases and just posted notice in case a quorum of either NTDF or City Council showed up. It was just a sloppy error and not an intent to violate the law because it wasn't a secret was it? This post is what is called a buzz kill. Sorry

  37. Again, 6:15, CVA is not required to post notice for it's meetings and is not subject to Missouri Sunshine laws unless a quorum of Council or one of its committees is present AND they discuss City-related business (e.g. policies, funding allocations, etc.).

    And there is no exception for "out of town". As long as a quorum is present and City business is discussed notice of the meeting must be posted. Period. In fact, out of town meetings, posted or not, run counter to other provisions of Missouri Open Meetings law (i.e. that they be held at a time and place generally accessible to the public that they serve) and, except under limited circumstances, should be avoided.

    Remember, Wagner is the one who had to leave. That's because he and Reed constitute a quorum of a Council committee.

    They could have legally continued with the meeting with Circo, Marcuson, and Reed inside the meeting and Wagner outside in the hall cooling his jets.

  39. It was the expectation of an NTDF quorum, and the possibility of a council committee quorum that constituted a notice being required. The CVA is irrelevant... in so many more ways than just this meeting.

    The meeting was noticed by email, where invitees were bcc'd on things, so you couldn't tell who was invited. Sloppy, stupid mistake. But then this entire CVA money grab is sloppy and stupid, too, so I guess it's to be expected.
