New Nebraska Law in Fremont that targets the undocumented won't be defended by UMKC Law Professor Kris Kobach.
Michael Nolan, who directs Fremont's taxpayer-funded insurance group, the League Association of Risk Management, or LARM made it plain: "Let's cut to the chase: We don't even know him."
And really . . .

Sure, Kobach was gonna defend his ordinance for free but that still doesn't protect the town from other liability.
Overall . . . A great many folks in the down seem to be noting that they don't share Kobach's agenda.
"Kobach's interests are not the same as Fremont's. “We have no community of interest with Mr. Kobach,” he said.
"Arguing otherwise, Kobach said he drafted the Fremont ordinance and was selected by Fremont petitioners Hart, John Weigert and Wanda Kotas to represent them before the Nebraska Supreme Court.
"Kobach, a law professor in Kansas City, Mo., also works with the Immigration Reform Law Institute, which is the legal arm of Federation for American Immigration Reform (FAIR).
Meanwhile . . . The skinny seems to be that challenges to this law could be settled out of court and the "teeth" of this ordinance could be taken out given that many claim that under the Supremacy Clause in Article VI of the U.S. Constitution, state courts may not supersede federal law.
Still . . . It's an abrupt end to Kobach's legal adventures in this part of the nation that speaks to the fact that Federal Courts usually reject this kind of nonsense.
Could it be said that unlike you, Kobach has a job. At at UMKC where I think you said you 'attended'?

ReplyDeleteKobach said he was puzzled by LARM's decision to tap a lawyer who was not among the six that Kobach said are most qualified in that particular area of immigration law. Kobach said he is one of the six and, geographically, is closest to Nebraska.

Why is Kobach puzzled its their money they can choose whomever they want. No conflict of interest exist, LARM is just paying the bills and their client is City of Freemont. When your in a car accident ALLSTATE chooses your lawyer, not you. Most lawyers who PRACTICE LAW would know this point.
An IVORY TOWER--hate monger might not, as would a 2nd-Law Student not have knowledge of this poing.
Last night I dreamed Tony entered Mexico illegally, got arrested and was deported. He tried to explain his situation to police, but since he couldn't speak Spanish (that a language of an oppressive European colonial power) they couldn't understand him.
