TKC EXCLUSIVE AND BREAKING NEWS!!! KANSAS CITY STANDS AGAINST ARIZONA RACIAL PROFILING!!! CITY COUNCIL SOON TO REBUKE ARIZONA SB 1070!!!



This week the City Council in Kansas City is set to make nationwide news by standing up to racial profiling law currently creating controversy in Arizona and across the nation.

This initiative has been put forth by some of the bravest Council people and hopefully will earn the support of the entire body. If the Mayor's seemingly meaningless statements about Diversity are for real then he should sign on as well despite his recent GOP affiliations.

This is history in the making in Kansas City.

There's talk this thing could turn into an all out Kansas City Boycott of Arizona.

CALLING FOR THE STATE OF ARIZONA TO REPEAL OF ARIZONA SENATE BILL 1070 AND DEVELOP REASONABLE CONSTITUTIONAL MEASURES TO IMMIGRATION REFORM

Whereas, the State of Arizona enacted SB 1070, which was signed into law by Governor Jan Brewer on the 23rd day of April 2010, requiring all Arizona local law enforcement to investigate a person’s immigration status when there is suspicion that the person is in the Country unlawfully, regardless of whether that person is suspected of a crime; and

Whereas, Arizona SB 1070 requires Arizona local law enforcement to question those they suspect are illegal immigrants, whether or not they have cause to believe an illegal act has been committed; and

Whereas, Arizona SB 1070 requires Arizona local law enforcement “when practicable” to detain people who they “reasonably suspect” are in the county without authorization; compels Arizona local law enforcement to charge immigrants with a state crime for not carrying immigration documents, and creates a private right of action to sue cities upon belief that the local Arizona government has a policy or practice that restricts Arizona local law enforcement from implementing immigration law; and

Whereas, Arizona SB 1070 seriously undermines the United States Constitution which grants Congress the exclusive power over immigration matters; and

Whereas Arizona SB 1070 encourages racial and ethnic profiling and violates Fourteenth Amendment guarantees of due process and equal protection for US citizens, legal residents and visitors from being detained for being in the County unlawfully; and

Whereas, Arizona SB 1070 does not prohibit Arizona law enforcement officers from relying on race, ethnicity, national origin or language to determine who to investigate; and

Whereas, the United States is facing a recession, which has impacted municipal revenues and significantly reduced funding for local law enforcement; and

Whereas, Arizona SB 1070 creates an unfunded mandate for Arizona local law enforcement officials; and

Whereas, Arizona SB 1070 unfairly targets members of the Latino community and other minority communities in Arizona; and

Whereas; Arizona SB 1070 will jeopardize public safety and drive a wedge between law enforcement and ethnic communities; and

Whereas, numerous United States municipalities have condemned the State of Arizona for adopting Arizona SB 1070, including the City of Austin, Texas, the City of Berkley, California, the City of Boston Massachusetts, the City of Boulder, Colorado, the City of Brownsville, Texas, the City of Chicago, Illinois, the City of Columbus, Ohio, the City of El Paso, Texas, the City of Flagstaff, Arizona, the City of Hartford Connecticut, the City of Inwood, New York, the City of Los Angeles, California, the City of Oakland, California, the City of Pasedena, California, the City of Santa Ana, California, the City of San Francisco, California, the City of San Jose, California, the City of Seattle, Washington, the City of St. Paul, Minnesota and the Denver Public School District; and

Whereas, Arizona cities such as Flagstaff, Phoenix and Tucson are determining how to legally challenge Arizona SB 1070; and

Whereas, Arizona SB 1070 removes the American legal virtue that assumes innocence, placing a burden on Arizona local law enforcement to discriminate on the basis of race and ethnicity, and

Whereas, Arizona SB 1070 challenges the cherished civil liberties of all citizens residing in and traveling to the state of Arizona.

NOW THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF KANSAS CITY, MISSOURI

Declares its opposition to Arizona SB 1070; and

Urges the State of Arizona to immediately repeal this law; and

Calls for the National League of Cities to support those Arizona cities opposing Arizona SB 1070 in devising reasonable, constitutional alternatives to SB 1070, alternatives that recognize the need for federal level reform that assists struggling border communities while respecting the humanity of all people living and working in these communities; and

Calls for the the National Conference of State Legislatures to oppose Arizona SB 1070 and assist the State of Arizona in devising reasonable, constitutional alternatives to SB 1070, alternatives that recognize the need for federal level reform that assists struggling border communities while respecting the humanity of all people living and working in these communities; and

Calls for a United States Department of Justice investigation as to whether SB 1070 is unconstitutional and lawsuit to stop its implementation; and

Directs the City Clerk to send copies of this resolution to Attorney General Eric Holder, the local division of the US Attorney’s office, Arizona Governor Jan Brewer, US Senators Claire McCaskill and Christopher Bond, Congressmen Rev. Emanuel Cleaver, Sam Graves and Ike Skelton, Missouri Governor Jay Nixon, the Kansas City state delegation, and to the chief executive officers of the National Conference of State Legislatures and National League of Cities.

    This is not accurate. If this is put in there they will get killed. It's also the common mistake made by people who don't understand this law. There has to be a real reason to stop someone, real reason does not = looking like Tony. If they put that in there PHX will crush a dumb ass cow town for not understanding.

  12. I am confused, is the KCMO Council against the federal immigration laws or AZ enforcing them? Is there some kind of bet between the City Council and Mayoy on who can embarrass KCMO the most? Grandstanding...nothing more and nothing less. The AZ law is no more profiling than the KCP&L dress code or keeping the kids off the streets in the Plaza (none of which is profiling for the record). I wish we had some leadership in this town that solved our problems rather than chiming in on issues that are none of their business.

    Law enforcement can only check the valid residential status if the person is stopped during the normal investigation of a crime!

    False. It requires law enforcement to ask suspected illegal aliens to produce documentation... ie an Arizona drivers license. Nothing more. AND FYI, federal law already grants ICE the autority to stop anyone for any reason and demand proof of legal status.

    3) "SB 1070 requires Arizona local law enforcement “when practicable” to detain people who they “reasonably suspect” are in the county without authorization; compels Arizona local law enforcement to charge immigrants with a state crime for not carrying immigration documents, and creates a private right of action to sue cities upon belief that the local Arizona government has a policy or practice that restricts Arizona local law enforcement from implementing immigration law; and"

    Again, false. One only needs to produce a valid AZ drivers license or other state issued ID.

    Again comepletely false. States can not make laws that conflict with federal law. The Arizona law simply requires local law enforcement to abide by specific sections of federal law.

    How much more false can you get? SB 1070 specifically forbids using race or country of origin as a valid reason to suspect illegal immigration status.

    YES it does. It specifically states race and country of origin can not be used as valid reason to suspect someone is unlawfully in this country. Read the damn bill... do we have councilmen with a 3rd grade level of reading? Why can't they spend 2 minutes and read them damn law?

    Again false. Local law enforcement is already provided with funds to determine the identity of all suspects. The AZ law demands no more than that.

    Again false. The AZ law does not target anyone based on race latino or otherwise.

    9) "Arizona SB 1070 will jeopardize public safety and drive a wedge between law enforcement and ethnic communities;"

    Again false, legal latino immigrants are demanding just as much as other Americans that immigration law be enforced. In addition, illegal immigrant gangs are responsible for make Pheonix, AZ the kidnap capital of the world with an average of more than 1 person a day being kidnapped and dragged across the border where they are held for ransom. This number doesn't reflect the countless more kidnappings that go unreported for free of retribution of MS13 gang members.

    If the city council passes this measure, there will be problems.

    The law is the law and no one has the right to break it no matter what race they are.

  57. Whatever happened to the trucker arrested a day or two after they passed this, who ended up being held until his wife drove home and got his birth certificate to prove he was born in Fresno, because they decided the id he had on him wasn't good enough?

    Also, what about the passengers in cars being pulled over? There's no federal law that everyone has to keep proof of identification on them at all times. The way this is worded, they could pull over a car for having a tail-light out, decide that the passengers don't look or sound "American enough", and detain them until such timme as someone gets their birth certificate. In which case, yes, the Council statement is correct; with no evidence or reasonable cause to suspect them of a crime beyond what the officer assumes basedd on prejudices, they can be held.

The difference is that Arizona is actually ENFORCING the law, unlike our impotent federal government. If the federal government shirks its constitutional duties, then any state can step in to fill the void, and exercise power. That's how the USA works. It's in the constitution. Try reading, you self-righteous, arrogant liberals. Try actually knowing something about our great country before boycotting or "reprimanding" a state for doing the right thing - enforcing the law, and protecting the sanctity of their borders & citizen's security.

    You also must fail to understand that this law wasn't in effect yet.
    This law will actually keep things like that from happening, since local law enforcement have a better gauge on the community.

She is undocumented but has lived in the US and in the Kansas City area for many years. She was turned over to Immigration by the police in Arizona.

    I grew up in South Florida, lived in Kansas City for 8 years from 2001 - 2008 while stationed there in the Marine Corps and then stayed for a few years afterward. I have many hispanic friends from all over Central and South America as well as the Caribbean and they ALL agree with me and most US Citizens that our borders need to be secured. We should not be supporting people who are here illegally. I recently read an article in the Star about an illegal Mexican immigrant who was busted with hundreds of thousands of dollars worth of drugs in his vehicle in Kansas. He had already been deported FIVE previous times. Our borders are a joke. We need border guards every few miles who are skilled snipers. Use some non-lethal ammunition and I bet people will think twice about sneaking into our country. The liberals will ruin our country if given the chance. Sic Semper Tyrannis.

  73. The Az. law states that only law enforcement may question a person’s immigration status after that person has been stopped for violating a criminal law. For example; cop stops car for speeding. Makes contact with driver and asks for license, registration, and insurance. Driver is not able to produce any of the paperwork. So the officer now has three charges. Cop determines that party might not be in country legally. Cop then ask driver for any type of identification Visa or immigration papers. Driver is not able to produce paperwork, and from there ICE is contacted. If an American traveled to another country you are told by customs to keep your passport with you at all times to verify identification if you are stopped by that countries law enforcement. My last point is that since some people think that this law is to target people Hispanic people in origin; Mexico has some of the strictest immigration laws in North America. Plus, most cops already do what the Az. law requires. The borders north and south are our greatest weakness, and if we as a people can see that so can our enemies. I know that sometimes it is hard to believe that someone might want to kill you just for being an American, but you need to believe that there are truly evil people out there, and their sole purpose in life is to kill and then die.

  77. Many, nay most, of us 'screaming' and 'whining' about illegal immigration have been doing so for years- and were just as pissed off at Pres. Bush for failing to act. It's a convenient canard to label us all ignorant racists- avoids having to argue the real issue of ILLEGAL immigration. BTW I'm glad we have a black President- I just wish it was a black Republican. That's what has the conservatives "riled up"- a Democrat President with a Democrat Congress passing liberal legislation. Is it that hard to understand that you have to play the race card? Guarantee you the conservatives would be at the same fever pitch if the current occupant of 1600 Pennsylvania was white and the same legislation was being shoved down our throats.

    Your open borders viewpoint seems a really horrible idea... it takes the immigration issue to the most liberal conclusion and I like kicking it around. Well I do the kicking and you do the kicking BACK.

    That's all. One thing. Why did you call me Funkmann? I'm no supporter of who you said was a relative of yours! You dont' argue city politics tho with zeal, not that it matters. Just immigration and that's my current interest as I'm contemplating why I call myself a liberal when it's clear that on many things, I'm not.

    In fact, I'm struggling with my usual loyalties to things the ACLU supports (the bill of Rights and protecting individuals from the tyrrany of democracy) against this AZ business.

    Rush's substitute today discussed that but managed to blame the trouble on the wrong party. He conveniently forgot that Bush did far more with the Patriot Act and holding/torturing prisoners to take away citizen rights than Obama has even thought.

    Tho I'm very displeased with Pelosi just now on some privacy issues and am inclined to advocate voting out ALL incumbents and starting over. Orwell was just a few decades off on his Big Brother book.
