"It is evident the mayor was using taxpayer resources to campaign for light rail, I can only conclude that the Ethics Commission thinks that's okay."

Mayor Funky beats Ethics rap . . . This time.
Oh I do think a little trip down memory lane is in order here:
ReplyDeleteOctober, 2008: WORD IS THAT PR FLAK JOE MILLER AND CHIEF OF STAFF KENDRICK BLACKWOOD ARE SAYING THEY WERE ON THEIR LUNCH BREAK WHEN THEY DID THEIR WORK FOR THE LIGHT RAIL INITIATIVE!!!
Word is, Tony relied on spurious people with grudges for his "facts." The Ethics Commission agreed with Blackwood and Miller.
November, 2008: WORD IS THAT FOLKS AT THE JACKSON COUNTY PROSECUTOR'S OFFICE ARE FIELDING CONCERNS FROM FOLKS WHO ARE URGING THEM TO LAUNCH AN ETHICS INVESTIGATION OF MAYOR FUNKY!!!
WORD IS = made-up speculation. Well it won't happen now, and it was probably never going to happen.
December, 2008: WITH A NEW DEMOCRAT GOVERNOR AND NEW APPOINTMENTS TO THE MISSOURI ETHICS COMMISSION, THEY COULD COME DOWN HARDER ON MAYOR FUNKY THAN THEY HAVE IN THE PAST!!!
The key word here, Botello School students, is could. This was (and still is) sheer outlandish speculation, speculation that turned out to be 100% wrong.
So your lesson today, students of the Tony Botello School of Journalism, is if the mayor bleeds, he leads. Tony got this all wrong because he based his so-called "facts" on rumor and innuendo. And this is what you get. A tempest in a teapot. Or, smelly shit in an unflushed toilet.
Now class, let's review what one of the Mayor's future options is:
Elements of a Libel Case
A. The libeled plaintiff must show that defamatory statements were "of and concerning" the plaintiff.
B. The libeled plaintiff must show a false statement of fact.
C. The allegedly libelous statement must be sufficiently precise in its terms to have reasonably defamed the plaintiff.
D. A statement of and concerning a "public official" or a "public figure" must be made with actual malice in order for the plaintiff to prevail in a libel action. ("Actual malice" means making a statement with knowledge that it is false or with reckless disregard of whether it is false).
word is, the evidence is already being collected. ;)
Funk will get his.
ReplyDeleteTony's right.
Alas a lawsuit against our host Tony will have to have a name other than Anonymous or Asshole attached to it. So we know at least one person who won't be filing a libel action against Tony, eh 8:15PM?
ReplyDeleteFunkhouser did the same thing that elected officials have been doing for years. If he supported every lame TIF in KC he wouldn't even be questioned.
ReplyDeleteIt was Rus Johnson that screwed Light rail up. Funky was just doing waht Mensa Man told him to do.
