KCUR: Capital Murder Charge Filed Over Topeka Officer's Killing
Topeka Police Corporal Jason Harwood was shot to death during a traffic stop Sunday and already a death penalty case is on the table. Remember the Jackson County insiders have advised us that a capital murder charge against Southland killing suspect Brandon Howell could be months away. In fairness to them, they've said that they want to be deliberate and cautious with any death penalty charge that is NOT YET on the table. Also, some insiders in the prosecutor's office advise us that a special clause exists for cop killing charges in Kansas.
Make no mistake, Kansas City insiders are IN A RAGE over this delay in justice . . .
"She said she was going to get justice for the families, where is it?
"This is EXACTLY the kind of thing that make our County look weak and it's a mistake to think that the criminals don't know that our Prosecutor is soft on crime.
"If Topeka can do it, in this horrible case where a guy KILLED 5 ELDERLY PEOPLE then Jackson County need to be able to send the same message to criminals. Jackson County needs to be able to show that we take murder seriously and are prepared to act swiftly. Instead, Prosecutor Baker is going to deliberate and wait for capital punishment opposition instead of just doing her job and defending our community. If she has ethical problems with the death penalty, she needs to resign. In our state capital murder charges exist for exactly this kind of horrible murder case.
"Trying to play politics with this case is a very dangerous game she's playing. In the meantime, criminals in Jackson County are getting a first hand look that our prosecutor is slow to act and wavering in her commitment to upholding the law in a case that demands the death penalty."

I would wager that not many of them are exposed to the news enough to even know that the crime happened. Am I missing something or am I wrong?

So far we've successfully accomplished splitting Whites from Blacks, Men versus Women, the Wealthy versus the Poor, while degrading the reputations of the legal/law enforcement community, professional sports teams/players, and white-collar executives at the NFL, national media organizations, etc.
At this rate, the public (the few who are still paying attention) will increasingly grow disaffected, detached, and depressed. All the better for us to increase their tax burden, while granting ourselves tax exemptions, credits, and loopholes!!

Even more specifically, take a look at:
Article II, Section 7 which defines, “Riot Control Agent” as, “Any chemical not listed in a Schedule, which can produce rapidly in humans sensory irritation or disabling physical effects which disappear within a short time following termination of exposure.”
Article II, Section 9 which lists under “Purposes Not Prohibited Under this Convention” in reference to subsection D, “Law enforcement including domestic riot control purposes.”

With a side order of appeals to the highest courts in the land along the way to muddle up the "justice thing". And, by the way, millions of dollars in legal fees all paid for by the taxpayers.

So go for a quick and easy plea deal. And put it on the table for 5 only 5 minutes. Then its off the table.
How's this: Plead guilty to First Degree Murder on all counts. Life in a Super-Max / solitary concrete box with NO chance parole.
PLUS: He has to recant his not-guilty plea to the acquitted murder case, and provide details including where he disposed of the body of the young girl.
Then they throw him in a hole forever.
Otherwise Not-So-Mean Jean might fuck it all up. But it would also save the state the $$$ Millions that it would take for a Death Penalty case -- PLUS the mandatory and no doubt additional appeals process.
This would be a sentence worse than death for this fucking ANIMAL & MONSTER.

Totally agree with the tipster on this. For too long Jackson County prosecutor's office has been a political mine field instead of an agency that is there to seek justice on behalf of victims. While I'm in total agreement with the tipster, far too often the Black on Black crime doesn't get prosecuted at all. Leaving victims to be forced to walk the streets, attend church, work, live and play among the same people who have transgressed against them which leave no time or ability to heal; which is why street justice prevails. My only addition to the tipster is that justice needs to be delivered equally no matter if its a white elder couple or the black poverty stricken girl. Justice is justice and it should be available to all people no matter who is lined up politically, religiously or socially with the assailant.

That said, I think there are rights to appeal built into the court system, correct? I am not an attorney, but isnt that what an appellate court does? And aren't there rights to appeal to a Supreme Court in death penalty cases?
