Let's start with the facts . . .

Thanks to readers of this blog, we're sharing an image of the guy killed during a Shawnee gun fight, first responders coming to his aid and securing the scene whilst looky-loos stare in the background. The man lying on the ground was suspected in an assault of a woman with a child and an altercation that turned violent. The image is fair use and fair play given the tragic circumstances of yesterday's deadly shootout that continue to rock the nearby middle-class enclave of Johnson County.

But more than just an accounting of the incident, let's talk about the implications . . .

WAS THIS DEADLY GUN FIGHT A GOOD THING OR SIMPLY A SIGN OF INCREASING SUBURBAN VIOLENCE AND HIGHER STAKES FOR PEOPLE WHO JUST WANT TO DO A BIT OF SUNDAY SHOPPING?!?!

Internets tough guys talk a good game about freedom and fighting but most of them only confront a keyboard, a bag of Cheetos and crushing loneliness. Whereas some "progressives" continue their hope that Hillary will confiscate the guns of everybody who didn't buy her last book.

But I digress . . .

The question here is one of public safety, the Constitution and the tragic fact that gun fights simply aren't good for business no matter who wins.

  1. The suspect took a chance and lost out. Hopefully, he thought it was worth losing his life. I don't know what the law is in Kansas but conceal carry train in Missouri says you can't play the hero in cases like this. But because we have a race problem in the metro, it's likely the shooter won't face charges and the black guys accomplice will be charged with murder. That's how this is going to go.

  2. The shooting of innocent victims is a tragedy. However, the fact that a Good Samaritan killed one of the perpetrators is a huge plus in many ways. It provides identification, evidence and puts thugs on notice that people are not always going to dial 911 and wait around for help. The risk level to criminals has to increase if there is any hope for restoring a civil society. Gun control is not the answer. When we establish personal accountability and consequences the bullshit will stop.

  5. From the story, it seems likely that the person who shot the perp was protecting the life of another bystander. The perp's accomplice likely will be charged with felony murder. Should charges be brought against the shooter, I like his chances in front of a Johnson County jury.

  6. Kansas is a wildcard here. In many states, the presence of a gun in the possession of the attacker threatened everyone nearby -- including the good samaritan shooter. Under such an interpretation, a claim of self defense woukd be admissable. Regardless, this guy better have Kevin Jamison's number handy.

  11. No need for the Good Samaritan in Kansas to lawyer up, unless he was a felon too. The thugs clearly were using deadly force and a firearm to commit a felony crime. The three acted as part of their collusion and in Kansas that makes them share in the penalties for their crimes. In fact the surviving criminals could actually be held liable for the death of the dead shit bag in addition to the dead victim. The shooter legally owned a hand gun, he legally possessed it and he legally used lethal force in the presence of threat of life and grievous harm. The degree of force was reasonable given that the felons had already demonstrated their intent to kill. Under the circumstances the citizen had the authority to use deadly force under a damn good state law. If they charge the Samaritan it will be only to find him innocent and guarantee he can never be charged again related to the incident.

    Lets hope Jeff City reads the press and reviews the facts on this incident before making the mistake of being swayed by a couple of impotent area libtard politicians.

A "good Samaritan" who shoots somebody, for whatever good reason, will spend the next few years going through financial and legal hell, even if he/she does not face criminal charges (and not facing charges is NOT a sure thing in these cases). Ask a lawyer, even a lawyer who carries a piece and is in the NRA. You really don't want to shoot some evil doer, not ever, unless the only alternative is your own death.

  16. Police have released the name of the deceased alleged perp. A quick check of the Kansas Dept of Corrections search and the JoCo Courts search indicate the deceased had a criminal record dating back to '05 (criminal damage to property) and '10 when he was sentenced to 1 yr 9 months in prison for possession with intent to sell opiates.

  18. 1:47, I think you are wrong, for two reasons. First, the use of deadly force defense in Kansas applies both to prevent harm to yourself and to an innocent third party. Second, if in a crisis you pause to consider the legal nuances, it gives the perp time to shoot you first.

  22. I don't think the JoCo prosecutor would even bother to charge this Good Samaritan. He would be found innocent, and the jurors would throw him a party. I am sure that this scumbag's family will sue the Good Samaritan, but I hope that there will be a pro bono attorney waiting for him and a jury that tells this perpetrator's family to get lost. I am very happy that he happened to be there to take care of the situation. Sometimes we get caught up in technicalities, but what we really should do is "take care of business". This guy did. Congratulations.

    To Missouri readers: Any citizen of Kansas who can legally possess a firearm may carry it concealed with, or without a permit. They can also carry the weapon of their choice openly. In this case Good Samaritan 1's life was saved by Good Samaritan 2's timely marksmanship.

    Businesses can regulate both the open and concealed carry of firearms on their premises (building only). However there is no criminal penalty for carrying on premises signed as prohibiting firearms as long as the person carrying the firearm leaves immediately when requested.

    Kansas has a full array of statutes that facilitate the use of firearms in defending oneself, or another.

  30. Suspect #2 was arrested and booked yesterday. JoCo Sheriff's booking & release report indicates he's being charged with first degree murder (yes, that's what it states), aggravated kidnapping, and assorted other charges. Looked him up on the KsDept of Corrections, and I'm SHOCKED (not so much) that he is a convicted felon, just got discharged from parole in July after doing some nice time for involuntary manslaughter and distribution/sale of opiates.
