On a jr hi social studies report, a high school essay or a college term paper. If you do that and present it as your own work, thats wrong. 1:13, I don't chime in here but need to now. First, I am an attorney. I would stop short of using your limited knowledge Law According to Wiki to prove a cyber stalking case.
ReplyDeleteI can tell you with abject certainty, nothing written by the commenter pointing out plagiarization, comes close to "cyber stalking." Now, I've seen personal attacks waged on others here at TKC that go so beyond that definition that I'm surprised this site has not been shut down in a flood of legal filings.
My advice for you is to not threaten people with legal remedies you know nothing about. That, on it's own, is illegal.
And for a group that so clearly and often touts the joy of free speech, I find it amusing how quickly you go into attack mode once you hear something you personally don't like. You want to scream the N word all day, make sexual innuendo about most females, attack people, by name, then rant this is the last bastion of free speech. That is, until you find yourself in the sites of that same "freedom," then its time to sue someone and quote your vast legal knowledge and make threats.
Talk to an attorney if you have issues, don't trust wiki. You may get yourself in hot water doing that alone.
Also, if you check the law, a person can not bring charges against another under an assumed name. Why? There is no "personage" attached to it. You can call SuperDave names all day long, claim what ever you want, same as you could Mickey Mouse - "SuperDave," short of proper identification, is a "non person." He lacks "personage" as the petitioner of a civil case. You can claim anything you like about SuperDave or any other non-named person on here. You've not libeled anyone as they are a non-person.
On the other hand, when you attack people by their proper names, that's a whole different story and you expose yourselves to incredible fines and damages when you make wrongful claims or character attacks on them, as they are identified as a person. And when you identify that person and their line of work, its far more simple than you might imagine to prove damages.
Free speech is one thing. Hiding behind that Constitutional freedom to spew hatred and damage peoples character is another. You would find yourself in legal hot water much faster than someone who comments, "Hey, buddy, you lifted that passage and didn't credit the author."

I don't know why charges haven't brought this site down yet. And, it still could. I know it got close years ago when Tony lost one legal battle. If he was my client, I'd have a lot of pointers he wouldn't want to listen to, as this blog crosses the line daily in legally implicating ways.

Although that particular blog was written in the context of the Aurora shootings, The police shootings in 2009 are actually a much better example of this. The Boston Marathon Bombing is another example.
