Here's another look at a local politico playing fast and loose with rules of a municipal governing body . . .

The upshot . . .

JACKSON COUNTY INSIDERS SAY THE CHARTER DOESN'T ALLOW FOR THE APPOINTMENT OF AN ACTING COUNTY EXEC . . . IF THE EXEC IS TEMPORARILY UNABLE TO DO THE JOB, RESPONSIBILITY SHOULD FALL TO THE CHAIR OF THE LEGISLATURE WHO THEN HAS THE RIGHT TO MAKE AN APPOINTMENT!!!

(Article III, Section 4)

First, here's a statement from Mike Sanders who MIGHT HAVE VERY WELL RESIGNED FROM OFFICE WITHOUT ANYBODY NOTICING . . . We hear that he gave legislators an official note from a judge claiming to back this up, the same statement wasn't given to the media . . .

County Executive Addresses Executive Order

I want to thank all those in the community who reached out to offer their condolences on the passing of my father. As I have said before, he was the reason I got involved in public service. Both in the weeks leading up to his death, and in the weeks following, I have chosen to spend as much time as possible with my family, who have been the greatest comfort of all.

In my absence county business still goes on, and items need to be signed. That was the sole reason for the very simple and purely technical executive order issued last week. I understand that previous county executives have taken similar steps.

I will return to county business on Monday, September 21.

Thank you, again, to those who have been supportive and encouraging in this difficult time.

Fair play, here's part of an off the record statement that supports Mike Sanders . . .

"The Jackson County Charter provides for the appointment of an Acting County Executive. It is a regular thing, and always is a member of the top administrative staff. All County Execs have done it. It is a backup in the event of an emergency when the Exec is unavailable and floods, earthquakes and meteors hit. Or if something needs to be signed without delay and he/she is out of town."

ACTUALLY, THAT'S COMPLETELY INCORRECT AND IGNORES THE NEW CHARTER THAT WAS RATIFIED IN 2010!!!

Check Article III of the flimsy Jackson County Charter newly ratified - This section governs the activities of the County Exec.

Here's the kicker and what could be cause for concern . . .

ACCORDING TO THE NEWLY RATIFIED CHARTER, THE EXEC CAN ONLY MAKE AN APPOINTMENT UPON VACATING THE OFFICE!!! THERE'S NO WORDING ABOUT TEMPORARILY TAKING A BREAK OR APPOINTING AN ACTING EXEC PLACE HOLDER!!!

Again, don't take my word for it . . . Article III covers all of the actions of the exec and that unofficial, secret opinion from a judge we keep hearing about seems like nothing more than a scare tactic. There is some talk that in Article III, Section 6, Clause 1 is being touted as a loophole BUT that only pertains to "Directors of departments, offices not otherwise provided for, members of boards and commissions, and acting officers to fill any vacancy in any appointive or elective office EXCEPT THAT of a county legislator . . . So, as usual, it's possible for the secret note to be nothing more than a fugazi mostly political trick which happens all the time down at the courthouse.

Two things for those of you good enough to make it this far . . .

The most likely scenario . . . We don't doubt that Mike Sanders is once again making the rules up as he goes along and all of the Jackson County legislature it too cowardly to call him on it.

OR . . .

There could be even bigger news on the way and this "break" from County Exec job could be just a prelude to something that's even more shocking and possibly part of a permanent vacation from politics.

  4. so what we are saying is he has never taken 5 days of vacation before in his terms with the County... when do you ever see that guy in the building?? AND... he isn't the only one authorized to sign for the County, the Director of Finance and Purchasing has that Authorization.

    He's going through an awful time with the passing of his father. If he can't or won't to do his job, then he needs to resign or steps need to be taken to remove him from office. If he broke the law by appointing someone to his position, he needs to be punished. As he said, Jackson County's business goes on but there's no reason to break the law and his actions set precedence and should have consequences.

The charter says vacancy not a grieving process if there is a vacancy the legislature needs to replace him Skippy can't have it both ways .

  24. You'd think that Sanders would know this information being that he is a legal practioner. Like I always say... successful lawyers practice the law. Lazy, incompetent lawyers run for public office. They haven't proven me wrong yet. Knowing it all is vastly different from being a know-it-all.

  27. No matter how much you like or dislike Sanders, this is a non-story. This is NOT death incapacity or resignation creating a vacancy. It is a simply housekeeping device. Every County Exec has designated an acting County Exec to perform ministerial duties in his or her absence.

    No one is afraid to criticize Sanders or behaving improperly. What happened is that TKC misunderstood the nature of a simple Executive Order -- thinking it was a big scoop, and is now trying to distract from the egg on his face.
