Dr. Ernest Evans Considers The Constitution, Decision And Consequences In Ferguson

About the Decision

For the record, I am not a supporter of Darren Wilson or of Michael Brown. What I am a supporter of is the US Constitution. That document, in Amendments 5 and 14, guarantees Due Process to all Americans. And "all" means "all"--it does not say "Unless you are a white cop accused of murdering a black man in Ferguson, Missouri or a black man accused of raping a white woman in Carroll County, Mississippi". (Nothing personal against either local, very fine places I am sure!!)

 In the case of Darren Wilson we have witnessed a shameful attempt to deny Due Process by both implicit and explicit threats of race riots if he were not indicted. The great Supreme Court Justice Oliver Wendell Holmes put it best when he said of the jury that in 1913 was intimidated into convicting the innocent Leo Frank: "Due process does not become Due Process by securing the assent of a terrified jury."


The economist Milton Friedman used to say "There is no such thing as a free lunch" ie, there is a cost for everything. And, the black residents of Saint Louis are already paying a heavy price for this denial of Due Process: As of yesterday there had been 134 homicides in STL in 2014 compared to 101 at this time in 2013--with all of the increase being in black victims. (In all of 2013 there were 120 homicides in STL.) The cops in the Saint Louis have "gotten the message": Forget about Due Process if you are charged with racism.

So, out of sheer self-survival they are abandoning their duties in black neighborhoods. Nature abhors a vacuum--this vacuum is being filled by the gangs and criminal elements and violence is exploding in these neighborhoods. To the Toni Bones of the world: I do not dispute your sincerity, but you must face the fact that you have created a crime disaster in Saint Louis. If you continue your activities you are going to spread this crime disaster to every black neighborhood in America.

  2. Dr. Evans lobs in a softball across the plate. He speaks the truth, but implicit in his commentary, at least as I infer it, is that the system will prevail and the rule of law is still the rule of the land.

    With all due respect Doc., the rule of law has been too leaky a ship to put much hope in, for quite some time.

    The only thing, these "Protesters" understand, is violence, superior fire power and the will to use it lethally. While our President makes excuses for the "Protesters", the looting and criminality rampant in Ferguson, the rest of the nation, waits for the next Jordon to drop. The 4th Estate, culpable in this Progressive cancer that has metastasized in our urban areas all over America, makes bank and gathers power from covering favorably, these criminal eruptions and calling them "Protests".

    The media continues to obfuscate and divert attention from the almost unbelievable rate of African American criminality per capita and as a whole. The Liberal Progressive Socialism in place now, that has inculcated entitlement, violence, indolence and malevolence in the African American community is aided and abetted by the usual suspects. Academe, the 4th Estate, the Entertainment Industry, our politicians and the perps, running the streets who father and mother an ever increasing army of retarded, angry thugs whose lack of IQ and education tht deigns them good for only one thing, violence and crime.

    Again, Darren Wilson, accidentally exposed the face of African American intent in all of it's glory.

    It's Back To Blood" and the only thing that will count before long, in an ever growing number of communities, it is superior firepower and the willingness to use it that will determine your fate.

    Some would be surprised that a white man was lynched in Georgia by a prominent group of citizens.

    Readers would no doubt learn something new by reading the case synopsis.

  5. DEar Mr. Prophet: Greetings to my favorite commentator of my postings!! Yes, Leo Frank was lynched in Georgia in 1915 after the governor of the state commuted his death sentence. The governor who pardoned this innocent man never served in office again, the man who organized the lynching (Tom Watson) went on to become a US Senator.   8. The 13th amendment to the constitution says slavery is abolished except as punishment for a crime. There are a lot of people in prison now working for a dollar a day for for-profit corporations. Slavery is legal in the US as punishment for a crime. Right now. Today. Slavery is legal in the US as punishment for a crime. Read the 13th amendment.

  10. Totally agree with the statement. The grand jury determined there was no crime; therefore, there would be no indictment. Why is this so difficult to understand?

    As more facts come out this story will go away, and Michael Brown's mother and stepfather will be revealed as the attention seeking gargoyles aiming to profit from Michael Brown's death they are.

    His father seems to be the only reasonable person in that family. No wonder he left that crazy bitch.
