Jury Awards Nearly $1 Million For Age-Discrimination Case Against Employees Of Kansas Gas Service
The story, essentially is this . .. 5 older guys at Kansas Gas Service, the largest natural gas provider in Kansas, were fired for allegedly violating the company's computer use policy (i.e. sharing raunchy images). They claimed they were fired because the company was trying to cut costs and get rid of older employees, and had the evidence to back it up.
In the complaint, you'll see that the company has a history for giving slaps on the wrist for major infractions including failure to put the life-saving scent into gas to let people know if there's a leak, giving a warning to an employee for sexual assault, and more, yet when these men were caught sharing images among friends (and not toward those whom they knew would not be receptive, they were fired on the spot after decades of service without the warnings supplied to others.)
Here's the kicker: in addition to the nearly $1 million dollar award, the judge will decide soon how much to award for future lost wages which, according to their attorneys could be up to an additional $1 million. It's a pretty sensational story, and lets others know that even if an employer says "hey you sent around porn you got fired, you have no case," if in your gut you know you faced discrimination and were fired unfairly, you can come out on top.

ReplyDeleteIt's great to see this happening in a place where most workers have no unions to protect them from predatory employers.
ReplyDeleteManagers of many companies get bonuses if they can get rid of older longtime employees in a way that relieves the company of having to pay them pensions.
In a dirtbag region like Kansas and Missouri, employees usually have no recourse. Hope Kansas Gas Service has to pay through the arse for this.
