I happen to be spreading the word about this bogus lawsuit all over social media. I don't always agree with the stories Tony covers...but I lived in KC for 34 years before I moved to Vegas. And based on what I observed over the years I have NO CONFIDENCE WHATSOEVER in the KCFD firefighters union. My hunch is this suit is a way to silence someone shining the spotlight of truth on an organization that even Pendergast would have taken a liking to.

Tony, think this through very carefully. Louie is not interested in the alleged defamination. His probable primary goal is to learn the identities of John Doe 1 and 2. If those individuals are employed by KCFD, it could very well affect their employment. It may also affect the FLSA lawsuit. The bonus here is to close your site and your right to free speech.

ReplyDeleteThis is a private lawsuit...a tort case between the allegedly aggrieved (the union guy) and Tony, the publisher of facts alleged to be false. Its not a criminal case and it's not a Constitutional case.
There is no right to free speech to defame people. Mr Wright is going to claim he's been damaged by Tony's (allegedly false) claims.
THere will be no court appointed lawyers because it's not a criminal case. The best advice I'ce seen on here today is a suggestion for T to get a lawyer and STFU other than a profuse apology to Mr Wright, in hopes of limiting Tony's legal exposure.

I'm certain some legal eager beaver will offer to represent you pro bono - this is a nice freedom of speech case with a lot of attendant publicity. Hell, go to ACLU!
But if you've been intentionally reckless with the facts (and I hope that's not the case) you'll have to face up to that. Something tells me your due diligence in checking facts before you publish may be faulty as well. But I hope that's not the case either.
Rather than talk about doomsday for your blog, this is an opportunity to expose the corruption you are so passionate about. I expect this case will generate some national exposure, e.g., "alleged corruption in municipal union affairs" vs. "the little blogger with the grotesque model pictures who could." I say fight it all the way - you know, truth, justice and the American way.

ReplyDeleteI am thrilled to hear Tony is getting sued. A few years ago he made a very wrong and negative insinuation about a member of our family. He must not have had much more to talk about because he continued to make further negative insinuations about this person. His comments caused a world of rage in this person's career. A lawyer friend suggested that Tony should be sued for defamation of character. The problem with Tony is he makes the insinuation and says, "Well, this person is PROBABLY or MOST LIKELY doing such and such..." People don't read the PROBABLY OR MOST LIKELYS and they assume Tony's statements are true. Tony is smart enough to know this and he does it intentionally. My sources tell me he wanted to be a journalist and he could not get hired by any of the KC stations. Consequently he started his blog. If you notice, he really hits hard on TV personalities. I believe in what goes around comes around. Tony is due!

If he is making advertising money from his website then he will be held responsible for what he has done. The internet blogging laws have changed a lot over the last few years.
