The voters of Kansas City in the 3rd District will have their choice for a Council Candidate back on the ballot.

MICHAEL FLETCHER IS ENGAGED WITH KANSAS CITY IN A LEGAL BATTLE OVER MALICIOUS PROSECUTION AND THE ONGOING BEEF OVER A LAWSUIT AGAINST THE CITY AND INCUMBENT SHARON SANDERS BROOKS!!!
Check out Mr. Fletcher's answer and counter claim to the city's lawsuit.
Not that this suit has already been filed and Mr. Fletcher raises counter claims along with seeking "injunctive relief."
We hear that the reason Mr. Fletcher continues to seek injunctive relief despite the Finance Director "withdrawing his earlier withdrawal" is because when Mr. Landes office contacted Mr. Fletcher's lawyer to tell them they were "withdrawing their withdrawal," Landes allegedly refused to put it in writing until "Galen approved" the retraction. Mr. Fletcher's HEAVY HITTING LAWYER MIKE YONKE advised that, unless he immediately placed the withdrawal in writing the injunction would continue along with counter claims. . . According to Mr. Fletcher's camp, The City did not respond in a timely manner and now they will be on the line for hundreds of thousands of dollars in punitive damages. The question of timing comes into play given the ruckus taking place so close to Kansas City election deadlines.
Mr. Fletcher and his lawyer also want a judge to finally state that the City cannot, yet again, change their mind and decide that they are going to withdraw his ballot certification. Not that as the letter from Landes points out, Kansas City IS NOT dismissing their lawsuit against Mr. Fletcher, even though that lawsuit is based on the same facts which they have now recanted according to documentation obtained by TKC.
Mr. Fletcher and his attorney will also sue the city for malicious prosecution once they appear in court next week and file a motion to dismiss. The reasoining? According to The Fletcher Camp, the city now admits that 1) Mr. Fletcher doesn't owe any personal taxes and 2) that the basis for their suit is therefore false a court will have no choice but to dismiss which then creates the second cause of action, malicious prosecution, against the City.
Most importantly . . .
MICHAEL FLETCHER AND HIS LAWYER SEEK TO DIPOSE CITY MANAGER TROY SCHULTE AND CITY ATTORNEY GALEN BEAUFORT ALONG WITH ANYBODY CONNECTED TO THIS HOT MESS!!!
So here's where we stand:
Within a four day period the City of KC has . . .
1. Ordered its employees to conduct an illegal investigation of Mr. Fletcher's tax filings according to the claims in these lawsuits. There's also word thatno other candidate was investigated;
2. KCMO filed a lawsuit wherein they claim that Mr. Fletcher personally owed taxes which they now admit that he doesn't.
3. KCMO withdrew Mr. Fletcher's certification noting that he had paid his taxes and opened themselves to the claim that they have violated his civil rights along with making a mockery of the petition process;
4. Finally today KCMO is "withdrawing their withdrawal" of Mr. Fletcher's certification thereby ALMOST GUARANTEEING a jury verdict against the city and . . .
5. All of this hot mess has involved no fewer than four department heads (Finance, Revenue, City Attorney and now maybe even the City Manager) in a failed scheme that didn't collect any new revenue, didn't keep Mr. Fletcher off the ballot and further embarrased the City . . . Most importantly all of this COULD end up costing the City yet ANOTHER million dollar verdict if they refuse the offer to settle.
They only have a week to decide.

ReplyDeleteFact check: The suit against fletcher was not 4 days ago, it started in July 2010 for unpaid city taxes.

ReplyDeleteThat letter looks as though it was a written response to a general inquiry by Mr. Fletcher. So here is how it probably happened:
ReplyDelete1- Mr. Fletcher said to himself "I need some news"
2- Mr. Fletcher calls and inquires about something he already knows the response to but asks for it in writing.
3- Mr. Fletcher given letter in writing.
4- Mr. Fletcher calls Tony and says he was kicked off of a ballot knowing he wasn't but also knowing that Tony will post anything.
5- Mr. Fletcher then tells Tony he was put back on the ballot that he was never kicked off of and provides a letter.
Pretty egocentric and ridiculous on the part of Michael Fletcher.
Good for Mr. Fletcher! Landis is a lapdog anyway. He was not waiting for the attorney, he needed troy's permission. Stupid is as stupid does. If here were not a tool for the council, he would really have no function.

7:22, I think you hit the nail on the head. The only thing you left out is that the "news" Fletcher has to create has to somehow be related to civil rights or some other way of picking on him. This is necessary to fuel his "the powers that be are scared of me" theme.
