Kansas City politicos are looking to limit the ability of residents to fight red light camera tickets despite their legal language (typically) filled with holes.
City Attorney Galen Beaufort said the city ordinance, which allows cameras to document red-light runners at busy intersections, is legally sound.It's a scummy move from KC proper in an attempt to curtail the rights of the public to redress a grievance and one of the many disappointing actions from local government as late.
But he and other city officials acknowledged Wednesday they may need to tweak the ordinance or its enforcement.
Howard Lotven, a Kansas City defense lawyer who regularly practices in Municipal Court, said the ordinance was flawed and unenforceable.
I thiught this was about safety not collecting money. Ask Cathy "red light" Jolly. Time to get rid of the cameras.

it's the second option you fight. the first you simply avoid in the first place.
I've got a client who was ticketed even though he wasn't driving his car. This system of putting the burden of proof on the innocent person is immoral.

ReplyDeleteA ticket that shows a incomplete stop with no traffic in sight anywhere near is not making the roads safer. Notice how that majority of these tickets have nothing to do with crossing an intersection which is very dangerous. This is a profit generator for a politically well connected company and nothing else.
ReplyDeleteIf they want to fix the lights try a 4 way red for 15 seconds to stop all traffic and clear the intersection. Now that would help make intersections safer. That's not the point thought. $$$$$$ is THE point.

ReplyDeleteGot one in the mail today. They cannot prove I received such ticket, they cannot prove I was the driver. I will not immediatly pay...gonna wait to see what happens. I was following a big truck and when I saw the light it was green. it went yellow when I lost view apparently.
