TKC EXCLUSIVE!!! Latest Mammy-Gate Rumor: Firing arranged by Gloria Squitiro might not have been legal!!!
The folks at City Hall are still talking up a storm over the firing of Ruth Bates and the details keep pouring in . . . What TKC is hearing most often is a lot of frustration over how the firing went down.
AMONG CITY HALL STAFFERS THERE IS NO DOUBT THAT GLORIA SQUITIRO ARRANGED THE FIRING OF RUTH BATES!!! NATURALLY, THIS HAS ALL OF THEM ALARMED GIVEN THAT AN UNPAID, VOLUNTEER CAN HAVE THEIR JOBS TERMINATED!!!
Numerous reports from a few City Hall folks witnessed Squitiro on the phone discussing the firing and timing it with a trip out of town for Co-Mayors Funkhouser and Squitiro. Actually, I thought the move was pretty cowardly as well . . . For all of Mayor Funky's talk of "principles" Bates was fired under his watch using one of the most cowardly methods most people at City Hall had ever seen. The firing wasn't leadership under pressure but the actions of someone scared and eager to get out of the City to avoid further controversy.
Finally, there's more reports of yet another impending legal snafu for the Co-Mayors. More than one City Hall insider reports THAT THE FIRING OF THE VICTIM OF THE MAMMY SLUR WAS NOT SANCTIONED BY THE CITY'S LEGAL DEPARTMENT!!! Squitiro's order was allegedly carried out but not approved by anybody else at City Hall but the Mayor . . . Talk of this misuse of power is all the rage among people who didn't agree with actions taken by the Co-Mayors.

But she seems to be out of town with the Bearded Ghoul gorging on free food while Team Funk A Dunk continues on it's merry way preparing for the Grand Funk Railroad's Light Rail Conference... the same team members that screwed up the light rail tax abatement issue so badly and stupidly. Nice work Funk... Mayor Smart with Nothinghouser.
ReplyDeleteSince when is reassigning someone firing them? Should all 87 city employees whose jobs were eliminated and reassigned be considered fired or is this inflammatory language reserved for Mrs Bates?
ReplyDeleteSince when does the CEO personally fire people except their direct reports? That is what a Chief of Staff does. In this case it is not appropriate for Funk to fire someone who has filed a legal action against him. It could have been characterized as threatening her to drop the complaint.
Mrs Bates quit!
Would this weaken her hostile environment case? She had a chance to leave and she didn't want to?
Next time try reading the law. When you understand the law you will then be able to make an intelligent and informed comment.

ReplyDeleteThe firing was cowardly... cowardly. There is no other way to describe the chickenshit method. Squit, with the full knowledge of funk-ee, conferred with high level employees to fire Bates. These employees are not going to lie to cover squit's ample ass and the email trail will bear the truth. Perhaps the mayors miscounted the days or did not fully grasp the time limits on when a person can file a complaint and when a person can initiate a lawsuit.
Like the 15/25 year difference in taxing, they may not have bothered to confirm their rough knowledge.
Any attorney practicing labor law will confirm that the last thing you do is fire someone in the middle of an unresolved EEOC complaint. Perhaps Galen Buford did not do his job and let them in on this nuance? Hard to believe.
Bates was pushed out. She was offered unknown position at the water department. She did not ask for the move. She was not given a choice... either take this unknown position at 63rd street or be terminated, and she had that minute to make her decision. No court will uphold a contract made under duress. Signing an employment agreement for this illegal move would have been a contract. Squit wanted her out of City Hall, she did not want to have to see her every day.
There is no way that the mayors can survive this illegal action on top of the original actions. With the new resolution brought forward yesterday for city employees, elected officials and volunteers seeking donations to a legal defense fund ... well now.. that's a funk-ee of a different stripe!
You know... you can call it a "firing" all you want but she quit.

I would suppose you agree that whatever the outcome, this has been one nig public unseemly mess. And if the Squid herself was the quarterback of the final disposition of Miss Bates, I think there is going to be even more trouble for Mayor Smart with Nothinghouser. All of which he will have brought upon himself and will be well deserved.

why was she there alone? why didn't they do the correct thing and have her attorney notified?
I agree that this has been a totally unnecessary mess caused by poor judgement on one side and over reaction on the other. I do wish Gloria would stay home and conjure spirits or whatever she does in her private time. I think Bates should have taken the parallel Water Department job and then called her attorney. As it is she's done exactly what they wanted.

you cannot make someone do something they do not want to do. people have a choice. It does not matter what they wanted her to do. It is called undue pressure. ed wolf is not much of a man and certainly not a chief of staff. He has thrown away his dignity to serve gloria. It is really a sad tale.
