The upcoming August 7th primary is KAPUT as far as the Sheriff's race is concerned and a legal battle was decided this afternoon has broad implications across local law enforcement.

A quote from the Jackson County Democratic Committee:

"Jackson County Democrats win lawsuit; votes for Sheriff in August will not be counted. Judge David Michael Byrn makes it clear that the filing period and calling of election by the county was unlawful. Task of nominating candidates for November is now on the county committees, as it should have been in the first place."

A statement on behalf of Jackson County regarding a judge’s ruling on the primary election for Jackson County Sheriff:

“The Clerk of the Legislature, who serves as the election authority for candidate filing and calling county elections, asked for the assistance of the County Counselor’s Office in providing a legal opinion regarding the procedure to elect a sheriff to fill the remainder of the sheriff’s unexpired term, starting January 1, 2019. The County Counselor’s Office acknowledged a lack of clarity in the law on this point, but reviewed that law and prior precedent, and determined that the best way to proceed was to open candidate filings for a primary election. However, that determination was taken to court and the court has decided differently. The County will follow the court’s order.”

"Congratulations to the men and women of the Jackson County Democratic Committee. These elected members stood up to the bureaucrats in Jackson County and their effort to hold an election in violation of Missouri statutes.

It took courage for this committee to bring litigation to fight for what is right and they prevailed. The corruption in Jackson County has been nothing but criminal in the past years and this seemed to be another example of the bureaucrats in Jackson County thumbing their noses at the law. Who knows how much public money was wasted on this illegal effort and how many dollars the Sheriff candidates spent on this primary election that is now null and void. Hopefully there will be an investigation into that.

"Whatever the case, I am proud to be a member of this committee and I am confident that I speak for all of them in saying this committee stands ready to follow the law and appoint the democratic nominee for Jackson County Sheriff for the November 2018 election.

"Also great work by our attorney Clinton Adams who was exceptional explaining the issue to the court."

So, this legal move should slow the roll of interim Sheriff Forté who was appointed improperly just recently wanted former Sheriff Sharp to hand over his gun.



Forté learned former Sheriff Mike Sharp also did not turn in his firearm after leaving the department. Sharp responded with a message that reads: “I honestly didn’t know I still had it. All Forte had to do was call me and say something instead of making a big production of it. I have turned it over to my FOP (union) representative.”

Forgive the TKC digression but, again, Sheriff Forté was appointed improperly and any authority he has is not validated by the court.

AN INSIDER JAXCO STRUGGLE OVER THE INTERIM SHERIFF IS NOW THE NEXT BIG FIGHT AND FORTÉ IS NOT ASSURED THAT HE'LL HANG ONTO THE JOB!!!

TKC EXCLUSIVE UPDATE: WE HEAR JACKSON COUNTY ISN'T GOING TO VOTE ON THE NEW INTERIM SHERIFF UNTIL AFTER THE AUGUST PRIMARY AND NEW COMMITTEE IS ELECTED!!!

Sadly, the Interim Sheriff immediately took to Twitter following the ruling and doesn't seem to be close to stepping down despite questions about his legitimacy.



So, for now, Jackson County is basically working with an Interim Sheriff who was appointed without proper authority.

Here's how the ballot will be adjusted, this note will be added to ballots by election judges:

NOTICE

Pursuant to Judgment/Order of the Circuit Court of Jackson County, Missouri issued on July 31, 2018, the primary election for the Office of Jackson County Sheriff should not have appeared on the August 2018 primary election ballot and therefore any votes cast for that Office shall not be released or certified by the Election Board.

  2. The County Counselor also needs to put in his resignation today. I know it's popular to hate Frank but look no further than the counselor who should have known better. He's an old Sanders appointee and he needs to be gone quickly. Tonight would be appropriate.

  6. No doubt Caleb Clifford is the instigator of this and people with no moral backbone (County Counselor) caved to the pressure even though they knew it was wrong. Taxpayers are out tens of thousands in legal fees that could have been better used. Now Rinse and Repeat as long as Frank is in office.

  9. Dirtybl laundry time. When Forte was Chief he sent an email to division commander to let a wagon driver to work as much overtime as he wanted. To go to every community meeting in the City, even though he wasn’t assigned there. The officer needed money bad so Forte made a rule just for him.

  16. That isn’t dirty laundry. What he allowed Mel Harvey to do was downright criminal. Look for the emails between them, the fact that Virginia Murray signed illegal overtime slips and a board too afraid to deal with the level of crazy that Forte brought to the table. Get the emails. What we went through under that crook was horrible.
