OLATHE, Kan. -- The attorney for a suspect in an apparent road rage shooting says his client acted in self-defense. Jonathan Cullen, 34, is charged with attempted second-degree murder after he allegedly shot a man in a road rage incident, police say. The victim, Eduardo Camaraza, was taken to the hospital in critical condition with two gunshot wounds.

In Missouri this shooting would fall under the no duty to retreat law as it is applies to your vehicle, but in Kansas I don't think they have such a law. If I am correct the shooter has got to prove that the circumstances were such that getting an ass whooping justifies killing someone with a gun. Since this apparently was not a car jacking attempt there is not even a felony there on the ass whooper. This is one to watch.

Just the facts please said...

Any bets this shooter wasn't suppose to be in possession of a firearm?
