  1. She didn't act appropriately and neither did the officer. What I understand of the state law and the agreement or MOU that the hospital and police had she was absolutely acting correctly and the officer was wrong.

    However, her over-reaction to being placed under arrest turned a bad decision into a worse decision. She should have complied with the officer placing her under arrest and then let the hospital and it's lawyers deal with it. She placed herself in a position of jeopardy for additional charges and created a scene that got completely overblown.

    I'm NOT condoning what the officer did, I believe he was wrong, but the law is when a cop says you are under arrest you must comply or additional charges can be issued.

    Her screaming and pulling away just made it worse, but, now she'll become some type of martyr or hero for standing up to the police. It could have been handled much better on both sides but her reaction was just wrong!

  2. Hospitals should start funneling visitors through one entrance and deny the police entrance unless they are invited in or have a warrant.

    1:36 you're so full of shit. A nurse is in charge at a hospital not some cop looking to bend the rules. By removing her like he was trying to do was putting other patients under her care at risk. He had zero grounds to arrest her and in fact violated her rights as a health practitioner and citizen of the state.

    Supreme Court says warrantless blood draws in DUI arrests are unconstitutional.

    States may "NOT prosecute" suspected drunken drivers for "refusing warrantless blood draws" when they are arrested, the U.S. Supreme Court ruled in a 7-1 opinion on Thursday that found such tests "violate the Fourth Amendment".

    We reach a different conclusion with respect to blood tests. Blood tests are significantly more intrusive, and their reasonableness must be judged in light of the availa­bility of the less invasive alternative of a breath test.”

    Justice Sonia Sotomayor, joined by Justice Ruth Bader Ginsburg, would have ruled that both breath and blood tests are unconstitutional when obtained without a warrant, unless there are exigent circumstances. Alito responded to that argument in the majority opinion. “If a search warrant were required for every search incident to arrest that does not involve exigent circum­stances, the courts would be swamped,” Alito said.

    Supreme Court Rules Cops "Need A Warrant" For Blood Test After Drunk-Driving Arrest.

    WASHINGTON — The Supreme Court on Thursday clarified limits the Constitution places on police officers who seek to measure blood-alcohol level following a drunk-driving arrest.

    In a fractured ruling that commanded a five-justice majority, the court said police officers "need a warrant" if they want to test the blood of a motorist who gets pulled over for driving under the influence, but not if they want to conduct a breath test under similar circumstances.


    But the men appealed, arguing that criminalizing their refusal to submit to testing violated the Fourth Amendment, which generally prohibits unreasonable searches and seizures. Their respective state supreme courts didn’t buy it.


    But the "Supreme Court did agree" with part of the argument, at least with respect to direct "blood testing".
    Justice Samuel Alito explained that these tests “are significantly more intrusive” on privacy, so states "cannot" conduct them unless they "obtain a warrant first" !!!!

  14. Anyone following this story knows that the person from whom the officer was asking for blood was also a police officer from another department. As the story goes the officer guy was minding his own business and the SLC PD was throwing a high speed chase involving a lady in a car who crashed into the officer driving on the road and killed herself, injuring the driver cop. Now why the hell they wanted his blood is interesting since he was a victim and there sure was no hint that he was on drugs or drinking. Nevertheless, the SLC PD officer shows at the hospital and wants his blood and proceeds to step all over his dick. Sounds like the dumb ass got his training over at Independence PD. Someone obviously forgot to tell him that he is a cop, not a judge, and his authority is limited. I bet he is figuring all that out now.
